‘None opposes PML unification’


LAHORE – Punjab Chief Minister Mian Muhammad Shahbaz Sharif has maintained that none objects to the unification of various factions of the Pakistan Muslim League, but those who have been loyalists of a military dictator and have looted billions of rupees, must return the money and beg pardon from the masses.
He was addressing the 106th Founding Day ceremony of the Pakistan Muslim League held under the auspices of the Nazaria-e-Pakistan Trust in collaboration with the Tehreek-e-Pakistan WorkersÂ’ Trust here on Saturday.
Chairman NPT and Editor-in-Chief The Nation Majid Nizami presided over the ceremony, while Senior Vice-Chairman NPT Begum Majeeda Wyne, Vice-Chairman NPT Dr Rafique Ahmad, former Foreign Minister Sartaj Aziz, Mian Farooq Altaf, Waleed Iqbal Advocate, Mian Khalil Ahmed Sharaqpuri, MPA Rana Muhammad Arshad, Parliamentarians and a large number of PML workers attended the function.
Shahbaz, while tracing the history of PakistanÂ’s creation, said that the Muslims of the Sub-continent launched a movement for creating a separate homeland under the leadership of Quaid-e-Azam Muhammad Ali Jinnah and flag of the PML, and rendered sacrifices.
He lamented that after 63 years, Pakistanis had failed to establish Pakistan in accordance with the ideals of its founders.
‘Democratic dispensations were put in place, but the military dictators staged coups by hoodwinking people, and did nothing practically for them’, he observed, while asserting that someone perpetuated dictatorship in the name of Islam and others derailed democracy for plundering the resources sans running the country as per the teachings of the Quaid and Allama Iqbal.
‘Sacrifices were rendered for the establishment of Pakistan to live according to law and Constitution where equal opportunities be ensured for all with supremacy of law, equal rights for everyone sans any discrimination of caste, colour, creed and religion, and be called Pakistanis. But today, the elite have all facilities whereas poor are deprived of basic amenities’, he maintained.
Shahbaz Sharif mentioned that medical facilities were for the rich, while the poor were struggling to get medicines even.
‘Children of the elite get education from prestigious institutions, whereas admissions are declined to the poor in these institutions. This is not the Pakistan as dreamt by the Quaid and Allama Iqbal’, he said, while mentioning that Pakistan was rich in mineral resources, fertile land, water, mountains and talented people but despite this, goals were not materialised.
‘We will have to make a critical review of this fact. The world history is replete with examples of defeated nations making progress through hard work, and we can do the same and change our history through hard work, honesty and sincerity’, he stressed.
The CM also lamented that Pakistan was still forced to depend on foreign aids and compromise its freedom and sovereignty for very little money though the country was a nuclear power.
‘We are forced to actualise even those foreign dictations, which have no concern the teachings and philosophy of the Quran and Sunnah, Quaid-e-Azam and Allama Iqbal, and the sacrifices of martyrs of Pakistan movement’, he maintained.
About foreign debts, he was of the considered opinion that loans worth billions of rupees had not changed PakistanÂ’s destiny during 63 years.
‘On domestic front, huge loans were got written off on political grounds, and those are still the owners of factories and bungalows, while the poor are deprived of even basic necessities’, he said, while asserting that in Quaid’s Pakistan, there were news about its President taking commission in Agosta submarine purchase, and earlier the Hajis were looted.
‘New worlds are created through new trends, fresh approach, hard work and honesty and we will regain lost glory of Pakistan by acting upon these golden principles and will make it an Islamic welfare state in true sense in accordance with the ideals of the Quaid and Allama Iqbal’, he added.
He agreed to the proposals of Majid Nizami regarding unification of various PML factions. He strongly advocated the idea of saving every penny for equipping the new generation with latest knowledge, which would root out extremism and terrorism from the country.
‘Even from today if we start making earnest efforts for eliminating ignorance and illiteracy, then the failures of the last 63 years can be overcome’, he said, while mentioning the success story of the Daanish Schools in remote and backward areas.
He was of the view that these schools would be an important step towards realising dreams of the Quaid and Allama Iqbal.
‘In the past, had a dacoity of Rs 50 billion not been committed in the Bank of Punjab, and resources were not looted ruthlessly in the name of the Lahore-Kasur Road, Ring Road and other development projects, then all these resources could have been spent for the establishment of Daanish Schools and welfare of the people’, observed emotionally-charged CM, who also asserted that the loot and plunder would have to be eliminated for regaining the lost glory of Pakistan and making it a true Islamic welfare state in accordance with the ideals of founders. ‘Judicious distribution of resources will have to be ensured and we will have to march forward for making hard work, honesty and sincerity our motto’, he suggested.
Majid Nizami in his address said that the PML was the founder party of the country and it would also make the country strong and stable.
‘India is our sworn enemy and we should always be beware of it. It is unfortunate for Pakistan and the PML that a runaway retired General (Pervez Musharraf) has also set up a separate Muslim League and he is trying to come back again in the country, and God forbid that such time comes’, he said, adding, that the Muslim League had established Pakistan and this party would protect the country as well. He asked the CM to play his role for unification of Muslim Leagues. “If you (Shahbaz Sharif) can make your elder brother (Nawaz Sharif) agree to the PML unification, then no one in the world can stop the latter from becoming the Quaid of the unified Muslim League,” he said.
Majid Nizami lamented the fact that the PML was created at Dhaka, and unfortunately it was no more part of Pakistan.
‘It is now the capital of Bangladesh because of our failings’, he observed, while tracing the history of the Quaid-Allama liaison for the creation of Pakistan.
He rejected the assertion that Pakistan was a secular state, and mentioned that its founders wanted to make it an Islamic state.
He asked the CM to take care of the poor, who were dying of cold and hunger. He also objected to the view that a few Daanish Schools could make the country literate because ‘revolutionary steps can turn Pakistan into an educated country’
‘I have seen a woman with sword in one protest. God forbid that day should not dawn when the whole nation is brandishing swords, and see another French Revolution’, he warned.
Earlier, in his welcome address, Dr Rafique Ahmad paid rich tributes to Shahbaz Sharif on setting up of Daanish Schools for providing quality educational facilities to poor students whose parents could not afford heavy fees. He also lauded the CM for creating awareness regarding the ideology of Pakistan.
Majid Nizami also presented NPT-published book titled ‘Tareekh Al-India Muslim League 1906-1947’ to Shahbaz Sharif.

SC sends Brig Imtiaz, Adnan Khawaja to jail


ISLAMABAD – Former Managing Director Oil and Gas Development Company Limited (OGDCL) Adnan A Khawaja and former head of Intelligence Bureau (IB) Brig (Retd) Imtiaz Ahmed were arrested from the courtroom on Tuesday on the order of a three-member bench of Supreme Court.
The bench, comprising Chief Justice Iftikhar Mohammad Chaudhary, Justice Tariq Pervaiz and Justice Ghulam, was hearing a suo moto notice on the reported appointment of Adnan Khawaja as chairman OGDCL by the government.
The apex court also ordered seizure of the properties of both the men and rejected AdnanÂ’s bail plea. The court ordered Adnan Khawaja to submit a fresh surety bond in the SC while Brig Imtiaz had been asked to submit the bond in Lahore High Court within three days. Both the men were later shifted to Adiala Jail.
The Chief Justice asked Khawaja how did he obtain the posts – Managing Director OGDCL and chairman National Vocational & Technical Education Commission (NAVTEC) despite the fact that he, as NAB convict, was disqualified to assume such a post for ten years.
Khawaja was disqualified for a period of ten years from seeking or being elected, chosen, appointed or nominated as member of any public office, any statuary or local authority of government of Pakistan or granted any financial facilities in the form of any loan by any government bank.
ItÂ’s worth mentioning here that in the wake of the suo motu notice taken by the apex court and the subsequent revelations in the media, the government had cancelled the appointment of Adnan Khawaja as chairman OGDCL, only a day after he assumed the charge.
Appearing before the bench, Raja Aamer Abbas, Additional Prosecutor General NAB, informed the court that as per directives of SC he had obtained details from the Central Jail, Rawalpindi, according to that convict Brig. (Retd) Imtiaz Ahmad had already undergone sentence of 4 years, 5 months and 14 days whereas remaining part of his sentence is 3 years 6 months and 16 days, if fine is paid.
Brig (Retd) Imtiaz was sentenced in the NAB Reference No. 21 of 2000 for 8-year RI along with a fine of Rs 70,00,000 under Section 382-B Cr.P.C. by the Accountability Court, Rawalpindi, on 31.07.2001. He was released from jail on bail by the Lahore High Court vide order dated 08.06.2002 passed in Cr. A. No. 1096-M of 2002.
Similarly, co-accused Adnan A Khawaja was sentenced to 2-year RI with a fine of Rs 200,000 under Section 382-B Cr.P.C. by the Accountability Court, Rawalpindi, and out of his total sentence, he has already served 1 year, 1 month and 8 days, including the remissions, whereas the remaining portion of his sentence is 10 months and 22 days, if fine is paid.
After promulgation of the National Reconciliation Ordinance both Brig (Retd) Imtiaz and Khawaja claimed benefit of the same and ultimately vide judgment dated 04.12.2008 passed by the Islamabad High Court, they were acquitted of the charge. But the NRO was declared ultra vires in the SC judgment on December 16, 2009 as a result of that their acquittal was set aside.
During pendency of the appeal filed by Adnan A Khawaja before the High Court, his sentence was suspended by this court vide order 06.02.2002 passed in Cr. Appeal No. 22 of 2002 on furnishing surety bonds.
After getting acquittal from the Islamabad High Court vide judgment dated 04.12.2008 Khawaja was appointed as Chairman NAVTEC. After the declaration of NRO ultra vires of the Constitution vide the judgment dated December 16, 2009, he continued to perform his functions as chairman NAVTEC, although he was debarred from holding any public office for a period of 10 years, in terms of the National Accountability Ordinance, 1999.
Not only this, on September 07, 2010, he was appointed as Managing Director OGDCL. Therefore, in pursuance of the information so communicated widely, his case was taken up and it was noticed that he is enjoying the position contrary to the judgment of the Accountability Court and when the notice of the matter was taken by this Court, the competent authority of the government of Pakistan rescinded the notification of his appointment.
The Chief Justice said that it was moral duty to relinquish the job after the judgment. Raja Amir said that even the High Court judgment he was debarred from holding any government post.
Justice Tariq Pervez remarked, “After December 16, 2010 judgment you both – Khawja and Brig (Retd) Imtiaz – should have got the bail on fresh surety bonds, but that did not happen.”
Khawaja said, “My legal advisors had asked me not to worry and do not need to apply for fresh surety.” Brig (Retd) said, “I was not aware that the NAB case would revive after the SC judgment.”
The court observed that unless fresh surety bonds are not furnished their bail could not be extended. Therefore, police were ordered to take them into custody and send them to jail.
Ismail Qureshi, Secretary Establishment, has furnished the explanation, which would be considered on the next date of hearing.

Countdown begins for Multan


MULTAN – Despite devastating a number of towns across the country, the Nature does not show any sign of mercy as yet. This time the countdown has begun for Multan as a massive flood is heading towards the hometown of Prime Minister Yousuf Raza Gilani and Foreign Minister Shah Mahmood Qureshi from Head Trimmu in River Chenab.
Irrigation department said the current water discharge from Head Trimmu is about 320,000 cusecs that is expected to surpass the mark of 400,000 cusecs very soon.
“This flood is likely to pass through Multan on Thursday (today),” Iftikhar Ahmad Dogar, chief engineer irrigation, told the media men. He said all the protective dykes on Chenab River were intact and in good position.
The irrigation officials, however, fear that the link road leading to Head Muhammadwala from Multan may pose threat to the city as the road was constructed on a six-km long dyke that has reduced the width of riverbed considerably.
“The water level on the right side of the Muhammadwala bridge has reached the height it gained in 1992 when 700,000 cusecs water passed through this spot while the current discharge is below 300,000 cusecs,” disclosed an irrigation official on condition of anonymity.
He said the first defence dyke, Akbar Flood Bank, was in serious danger due to rising pressure of water and the only way to protect Multan was to breach the link road dyke. “But the National Highway Authority (NHA) officials are strongly opposed to this suggestion. Recently, the chief engineer irrigation held a meeting with the NHA authorities on this issue but they refused to break the dyke,” he added. He said the NHA officials were of the view that they would consider breaking this dyke when the water level would further rise by at least one more foot.
Meanwhile, the irrigation officials and Army jawans have been deployed at the flood banks of Chenab River and work is underway to strengthen the dykes.
The evacuation has started from the adjoining areas at flood banks like Aroka, Missi Pipli, Langar Sarai, Kotla Sadat, Faridabad, Kunnar Sharif, Mauza Ponta, Tahirpur, Fateh Bela, Sherpur, Sosan, Khairpur, Mahra, Dhondo, Gardezpur, Jalalpur Khakhi, Jhangi Bhana, Aman Ullahpur, Ghauspur, Sheikhpur Darugh, Panjani Khaas, Panjani Khakhi and Thatha Makhdoompur have come under floodwater in Multan district.
AFP adds: Authorities issued fresh flood warnings on Wednesday, putting parts of Punjab and Sindh on alert and calling on foreign donors to step up efforts to contain the countryÂ’s worst humanitarian disaster.
Government has admitted being unable to cope with the scale of the crisis and an outpouring of rage from survivors and the political opposition is compounding pressure on President Asif Ali Zardari.
The meteorological service warned of floods in Hyderabad district, which could spread devastation further south in Sindh province, and issued a “significant” flood forecast for Kalabagh and Chashma in Punjab.
Local governments in both provinces, considered the breadbasket of Pakistan, also issued warnings about more flooding in the days ahead, although the chief minister in Sindh acknowledged that the immediate danger had passed.
Punjab officials said more than 90 percent of the town of Kot Addu had emptied and that flooding had cut electricity and gas production, shutting down thousands of factories.
The chief minister of Sindh, Syed Qaim Ali Shah, told a small group of reporters that up to 3.5 million people could be affected in the province, although loss of life had been negligible.
“Up to 40 kilometres of Indus Highway is inundated and has been closed. The initial rough estimates show that losses of Rs35 billion, excluding crops, have been suffered by Sindh,” he said.
“I think the actual losses will be much higher. We feel that without substantial foreign assistance it will be difficult for Sindh and rest of the country to redevelop and rehabilitate its people.
“What we need is substantial foreign aid and not peanuts. The aid being pledged so far is peanuts and not enough to meet the enormous challenge ahead.
“The immediate danger is almost over, but we are concerned about the next possible big wave of flooding, as predicted by the Met department.
“If it is progressive flow it should be fine, but if it comes at once then it will be a trouble.”
Government says 14 million people are facing direct or indirect harm, while the United Nations has warned that children are among the most vulnerable victims, with diarrhoea the biggest health threat and measles a concern.

Phet batters Pak coastline


KARACHI\QUETTA – Cyclone Phet weakened Sunday after hitting Thatta and Badin but spared Karachi along the Sindh coast.
Heavy rains and winds lashed Karachi and other cities, killing at least 14 people as the cyclone swirled along the coastline after killing 16 people in Oman.
“The cyclone moved rapidly eastwards in last six hours and went away from Karachi’s coast after hitting Sindh’s Thatta and Badin coastal districts,” Qamaruz Zaman Chaudhry of Meteorological Department, said.
“The cyclone will turn into depression in the next 12 hours, which will result in further widespread rains in Karachi and other coastal parts of Sindh,” Chaudhry said late Sunday.
Cyclone Phet was earlier expected to landfall near Karachi with maximum winds of 100 kilometres an hour but it did not hit the commercial capital. The outer circle of Cyclone Phet spared the City by miles.
Rains accompanied by gusty winds hit the coastal areas of Thatta including Keti Bandar, Khharochhan, Shahbunder and Jati. The city was inundated by rainwater and all the roads and streets, including Shahi Bazaar, were submerged in knee-deep water due to failure of drainage system.
Tens of thousands of people were evacuated from vulnerable coastal villages in Sindh, but thousands more refused to abandon their homes. Hundreds of relief camps have been established in the affected areas but people have complained about the lack of facilities.
Media teams, rescuers and police personnel left behind in ThattaÂ’s coastal town of Keti Bandar have been asked to immediately evacuate the town. Keti Bandar having a population of more than 5,000 had already been evacuated. However, around 100 persons were marooned in some scattered villages till late in the evening.
The Army has mobilised its soldiers for rescue and relief operations in the coastal areas of Sindh and Balochistan. The ISPR said four battalions were on high alert in coastal areas.
The cyclone moved past Karachi without hitting the coast, said Meteorological Department. According to Met Office, two-to-four metre high tides are expected in Karachi coastal areas while more torrential rains are expected during the next 36 to 48 hours.
Many Karachi and Hyderabad areas were still without electricity. Three people were killed in rain-related incidents in Hyderabad.
At least 10 people lost their lives during heavy rains caused by cyclone Phet in Karachi.
The irregular downpour struck the City in the wee hours of Sunday and paralysed the whole of the metropolis where commercial and non-commercial activities remained suspended.
As many as 10 people died in different rain-related incidents while dozens of road accidents left scores of people wounded in different areas of the City.
Officials in Abbasi Shaheed Hospital, Civil Hospital and Jinnah Hospital confirmed arrival of hundreds of wounded persons who fell victim to road accidents.
A youth Waseem Ahmad died when an electric wire fell down in front of his home at Chowkandi Graveyard. Police officials said the victim tried to have the electric supply through (Kunda) but lost his life after touching the electric pole.
A woman Jannat Bibi died in an electrocution incident took place at her home located at Daud Chowrangi. Yahya, 12, died at Nazimabad No 2, while Muhammad Nadeem was electrocuted at his home at City Railway Colony in the limits of Mithadar Police Station. Saleem Khan, 18, was electrocuted at Baloch colony.
Separately, an unidentified body of a youth was found at Burns Road Street No 2 where an electric line fell on the ground causing injuries to seven people at Sharah-e-Faisal.
Another incident took place within the limits of Azizabad Police Station where a young man died because of the electrocution.
The City slum areas including Old Saddar area, Ibrahim Hydery, Saddar, Ebrahim Hydery, Baldia, Maripur and other slum area were drowned as the rainwater entered most of the homes.
On the other side, Pakistan Fisher Folk coordinator, Sami Memon, said more than 1,000 families from Bhit Shah Island and Manjhar Goth migrated to Ibrahim Hyderi, denying staying in relief camps as these places are not suitable for their survival. That is why, more than 13 camps established by the government are lying empty in Bin Qasim Town.
Meanwhile, extraordinary torrential rains generated by cyclone Phet in the coastal areas of Balochistan have caused widespread devastation, playing havoc in a number of towns, especially Gwadar which is completely submerged in rainwater. The downpour and resultant flooding have also claimed one life and injured many others.
“0.25 million population of Gwadar is waiting for relief as water up to three to five feet is standing in the streets and houses,” Attaullah Mengal, Deputy Director Disaster Management Authority (NDMA) Balochistan, told this ascribe on late Sunday night.
He said coastal town of Gunz was completely washed away while 50 per cent of Jiwani town had been destroyed due to the cyclone.
He said the government was facing an uphill task of relief and rescue as no flight could be operated to Gwadar and other coastal towns like Ormara, Jiwani and Pasni as heavy flooding had submerged the landing strips and airports.
He further informed that Pishikan area of Gwadar and some other nearby localities were the worst affected by the cyclone, adding that a survey of these areas would be started soon after the conclusion of relief activities.
Meanwhile, the NDMA and some international relief agencies have contacted PDMA for supply of relief goods in the affected areas.
When contacted, Noor Mohsin, a local journalist of Aaj TV, said the people of Gwadar, which bore the brunt of the heavy downpour, were waiting for the relief and rescue operation.
He said although the Army and the Frontier Corps had initiated relief operation on a limited scale, it was extremely insufficient in the face of huge damages in Gwadar and adjoining villages. He also said five camps had been set up for the affectees but they were not satisfied with the efforts of the local administration.
On the other hand, ArmyÂ’s C130 aircraft loaded with medicines, food, drinking water, tents and other items could not take off both from Karachi and Quetta for Gwadar, as its airport had been rendered non-functional.
Deputy Commissioner Pasand Khan Buledi, who shifted his office to NavyÂ’s relief camp after the rains, told TheNation that the local administration was making all-out efforts for providing relief to the people. But cited the absence of land and air links within the district and rest of the country as the main hurdle in the operation.
The whole Gunz town has been washed away, however, its population of around 4,000 was shifted to safer areas while majority of the population of 20,000 in Jiwani was either shifted or moved to mountainous areas.
Meanwhile, a special cabinet meeting in Quetta with Chief Minister Nawab Aslam Raisani in the chair, decided to donate their one-month salary for the flood and rain affectees.
The CM had already announced Rs50 million for the relief and rescue operation.
According to a Press release of Frontier Corps (FC), personnel of Pak Army, FC and Coast Guards were busy in relief activities in different cyclone-hit areas and shifting the people to safer places while relief camps had been established in which items of daily use were being provided to the affected people. Medical aid was also being ensured while 18 trucks of the Army and FC loaded with goods were also sent to Gwadar through a C-130 flight.

SC gives govt two weeks to submit clear reply


ISLAMABAD – Supreme Court on Tuesday gave the government two-week ultimatum to submit a report on steps being taken to reopen corruption cases against President Asif Ali Zardari and other politicians. A panel of five judges questioned Law Minister Babar Awan in the court, giving him two weeks to submit a “concise” report and adjourning the hearing until June 10. “There should be a clear reply as to what steps have been taken in implementing the NRO verdict and whether the government intends to implement the whole order or not,” said Justice Raja Fayyaz.
On its part, the government surrendered before the apex court verdict on NRO, as Federal Minister for Law and Justice Babar Awan while appearing before the court agreed to submit a concise report on details of graft charges of $60 million against President Asif Ali Zardari.
Accompanied by more than 15 federal ministers and advisers, Babar Awan appeared before the five-judge bench of the Supreme Court headed by Justice Nasir-ul-Mulk and comprising Justice Jawad S Khawaja, Justice Raja Fayyaz Ahmad, Justice Tariq Pervez and Justice Rehmat Hussain Jafferi and told that he had documents containing certain aspects which had never come before over the issue.
“There have been no proceedings. There was absolutely no case,” he asserted. Citing legal provisions, he said no prosecution ever took place and the issue was confined to investigation process only. Awan further told the court that the government had implemented nine out of ten directions envisaged in the Supreme Court’s NRO verdict while on tenth one, process was in place having legal intricacies. The court, however, ignoring the legal implications including the presidential immunity, inquired about $ 60 million, which put him into trouble.
To Justice Raja Fayyaz AhmedÂ’s question over claimantsÂ’ status on this amount, he said that he did not know about them.
Arguing different aspects of the Swiss cases Babar Awan claimed before the bench that no case was filed against President Asif Ali Zardari in Switzerland. Justice Jawad S Khawaja asked Babar Awan to tell the court about the current status of $ 60 million regardless of other aspects of the case.
Babar replied that it was merely a notion and an exaggerated figure.
Several federal ministers and high profile government figures including Qamar Zaman Kaira, Raja Pervaiz Ashraf, Ayatullah Durrani, Makhdoom Amin Fahim, Sardar Assef Ahmad Ali, Latif Khosa and other PPP leaders including the presidential spokesman Farhatullah Babar were present in the courtroom.
Awan was summoned by the court to explain the reasons for the delay in the implementation of the courtÂ’s verdict on NRO. The federal law minister said the government was not using the delaying tactics for implementing the NRO verdict. The federal law minister said the summary for reference against former Attorney General Malik Qayyum has been sent to Prime Minister Syed Yousuf Raza Gilani. Two National Accountability Bureau (NAB) courts have been sanctioned to be constituted in Islamabad, he informed the court.
The number of prosecutors of National Accountability Bureau (NAB) is being aggrandized, the federal Law Minister informed the apex court adding the amazing facts will be uncovered, if the documents regarding the former AG is presented. “We have removed the Prosecutor General and two NAB courts are being constituted,” he added.
Agencies add – During the 90-minute hearing, Dr Babar said the government was “meeting day and night” to implement the December 16 verdict. The five-member panel asked the law minister about re-opening cases against Zardari in Switzerland and steps being taken to bring back 60 million dollars lying in Swiss banks. “There is no such amount. This amount is not there. These are only allegations, and wrong and malicious statements,” Babar said, referring to “legal complications” and “grey areas” in approaching the Swiss authorities. Babar apprised the Supreme Court that no judicial proceedings had ever taken place on Swiss cases, which were confined to investigation process initiated on baseless allegations. On this, the bench observed that the record available with Supreme Court provided by National Accountability Court (NAB) spoke otherwise.
The law minister maintained that the cases were closed on merit by the authorities concerned and not merely on request of the former AG. He read out Aug 25, 2008 Order of the Public Prosecutor of Republic and Canton of Geneva which said that proceedings were not simply closed on then AGÂ’s request in his letter dated May 22, 2008. The prosecutor general personally reviewed and analysed the testimonies collected by the investigating magistrate of Geneva and decided to close the proceeding after examining the merits of the case, he added.
Elaborating further Babar Awan said parties were informed under Article 192 of Swiss Penal Code, that they could file appeal against the order within ten days but no appeal was filed so the order attained finality and the proceedings in Switzerland were closed. He questioned the role of former attorney generals for seeking legal assistance from the Swiss authorities.
Dr Babar Awan said there was no authorisation to Saif ur Rehman by the government delegating powers to him which was also contrary to Article 100 of the Constitution. “Investigation was carried out and the amount was exaggerated. There was a stay order which continued for years,” he added. He ruled out that the alleged money belonged to PPP leadership and said it was not determined in the investigation process. “From the year 2001 to 2008 nothing happened in proceedings,” he added.
The bench exempted Babar Awan from appearing on next date of hearing and file his written statement regarding complete implementation of NRO decision. The hearing was adjourned till June 10.

Bike bomb kills DSP, 12 others in DI Khan


PESHAWAR – At least 13 people including a DSP, policemen, women and children, were killed and 14 others got injured in a remote-controlled bomb blast in Dera Ismail Khan on Tuesday.
The bomb planted on a bicycle was detonated near a police van, escorting the Deputy Superintendent of Police (DSP) Kalachi, Muhammad Iqbal KhanÂ’s car, police sources informed.
Eyewitnesses said the blast occurred soon after the DSP left his home at Kutchi Painda Khan area in the suburbs of the city. The DSP, his driver, bodyguard, two women and two children were among the deceased, police sources informed, adding 14 others were injured and five of them were stated to be in critical condition.
Local sources informed it was a huge blast and was heard miles away. Bomb Disposal Squad (BDS) officials said four to five kilograms explosive material was used in the device, which was detonated by a remote control.
Police and other law enforcement agencies rushed to the scene and cordoned off the entire area, while rescue teams shifted the injured to District Headquarter Hospital.
Police said that Asif Iqbal, young son of the deceased DSP, was also among the injured. According to hospital sources, besides DSP Mohammad Iqbal Khan, his gunman Irshad, driver Mohammad Mushtaq, Bashir Ahmad, Mohammad Irshad, Insaf Bibi, Irum Bibi, Mohammad Younis, Arsalan, Sabir, Abdul Sattar, Shahzeb and an unknown man were among those who were killed.
The injured were identified as Bakhtullah, Mohammad Sharif, Asif Iqbal, Mulazim Hussain, Shah Jehan, Bashir Ahmad, Jamshed, Ghulam Hussain, Mohammad Ramzan, Rehmatullah, and an unidentified child.
“Five among the injured are in critical condition,” hospital sources informed.
“Nobody has claimed the responsibility of the attack,” police sources informed and added that investigations were in progress.
Chief Minister Khyber Pakhtunkhwa Ameer Haider Khan Hoti ordering an inquiry into the attack has termed it a cowardly act of terrorism. However, he vowed that such incidents couldnÂ’t deter his GovernmentÂ’s commitment to war against militancy and terrorism.
Meanwhile, President Asif Ali Zardari, Prime Minister Syed Yousuf Raza Gilani, Speaker and Deputy Speaker National Assembly Fehmida Mirza and Faisal Kundi have also strongly condemned the attack and extended their sympathies to the bereaved families.

‘Tough, tight, hard budget coming’


LAHORE – Financial experts, economists, political leaders and intellectuals on Saturday warned that the forthcoming budget 2010-11 would be tight, tough, and hard for the masses as the government was all set to impose heavy taxes with major reliance on foreign borrowings.
They also predicted that inflation and fiscal deficit would swell substantially, forcing the government to slash the Public Sector Development Programme (PSDP) funding in case the rulers failed to cut down non-development expenditure.
They also argued that economic mismanagement and cut in PSDP coupled with high inflation could lead to slowing down of GDP growth which had already been recorded at very low, i.e., at about two per cent.
They also asked the financial managers of the government to take the situation more seriously in order to tackle the emerging economic, security, governance and political challenges.
The speakers were addressing the annual pre-budget seminar ‘Challenges to the Economy’ held under the aegis of Nawa-i-Waqt Group in collaboration with Muslim Commercial Bank (MCB)/Privilege at a local hotel.
Chairman and Managing Director Nawa-i-Waqt Group Majid Nizami, Deputy Managing Director Nawa-i-Waqt Group Rameeza Majid Nizami and Justice (r) Mian Aftab Furrukh were also present on the occasion.

Addressing the occasion, Senator Ishaq Dar termed the last decade a ‘lost decade’ and said during this period the former regime had failed to increase the tax to GDP ratio, which had decreased 14 per cent to nine per cent.
“We need to create a tax culture and wealth tax is a best option in this regard. We are terribly relying on indirect taxes. We have to impose taxes on those who have the capacity to pay. We have to increase direct taxes and not the indirect taxes,” Dar maintained.
He strongly criticised the imposition of Value Added Tax (VAT), saying, “It is indirect tax. It is going to create huge inflation in the country. It will also hit the people hard.” He further said that VAT would be a failure from the very first day.
According to him, 16 per cent GST would swell to about 23 per cent in case it was replaced with VAT.
Sartaj Aziz, while addressing the participants termed, the less tax to GDP ratio a chronic problem but said as far as foreign exchange reserves (above $15 billion) and Current Account Deficit (C/A) were concerned, the situation was better during the current year as compared to the previous one.
He said the C/A deficit had come down due to decrease in import of machinery.
Minister for Privatisation Senator Waqar Ahmad advocated for taking out-of-the box decisions to defeat the present economic condition. Drawing outlines of the weak economic situation, he said the time had come to focus on economy after settling down political issues; otherwise the situation would become shabby.
In the context of huge debts on three major companies OGDC, PSO and PPL, he counted the circular debts as major problem forcing the nation and the industry to face gas and power shortages, which had in turn resulted in less productivity, unemployment and economic miseries.
Dr Aisha Pasha, Director Institute of Public Policy, Beaconhouse National University, stressed the need of resources mobilisation as a means to increase GDP. She also spoke for enhancing tax to GDP ratio so as to enhance spending on public sector programmes like education and health.
Former Governor State Bank of Pakistan Dr Ishrat Hussain said the problems of Pakistan lay in the economic policymaking. He pointed to lack of implementation capacity as a serious issue at the governance level.
He also urged the need to centralise the distribution of resources.
Stressing the need of political consensus, Ishrat said continuation of economic policies could help revive national economy.
Vice-Chairman Nazria-i-Pakistan Trust, Dr Rafique Ahmed said the affluent classes of the society should be taxed properly for generating the resources.
Underlining the need for fundamental reforms in the taxation system, he proposed that real estate, agriculture and corporate sectors should be taxed properly, so as to ensure equal distribution of taxes among all the classes of the society.
Mrs Shafqat Sultana, President First Women Bank, speaking on the occasion said fair taxation system was the need of the hour while the upcoming budget should reflect the needs and demands of the people.
Import duties should be increased, while the Pakistani embassies should play proactive role for increasing the exports, proposed Shafqat.
Addressing the seminar, Tariq Jamil, a leading banker, suggested 50 per cent voluntary cut in the salaries of all the ministers at both federal and provincial levels and a voluntary freeze on payments of salaries (not expenses), for five years, to all members of the National and provincial assemblies as well as Senate. He also proposed relocation of offices of the President, Prime Minister, all federal/provincial ministers and governors of provinces to austere and inexpensive accommodation to put the house in order.
Referring to the challenges faced by the economy and its long and short term solutions, prominent economist Dr Shahid Siddiqui stressed upon revisiting the policy on war on terror, reducing unproductive expenses, increasing direct taxes at the expense of indirect taxes, deferring levy of Value Added Tax at least for one year and focusing on health and education.
KM Azam said foreigners were interested in investing in the country but it was bureaucracy that had been creating hurdles.

A five judge larger bench of the apex court headed by Justice Nasir-ul-Mulk and comprising other four judges including Justice Raja Fayyaz Ahmad, Justice Jawad S Khawaja, Justice Rehmat Hussain Jafferi and Justice Tariq Pervez while hearing this case observed contradictions among the statements of Attorney General, Additional Attorney General and NAB officials. Justice Nasir-ul-Mulk said that it is better to hear the relevant Minister on this issue to remove the contradictions, adding that NAB wrote two letters for the reopening of Swiss cases while contrary to this Law Ministry told the court that these cases could not be opened.
Attorney General Maulvi Anwar ul Haq told the bench that Law Secretary Justice (Retd) Aqil MirzaÂ’s resignation was accepted, as due to unstable health condition it was difficult for him to continue his work. On this Justice Raja Fayyaz asked if his health condition was not satisfactory then why he presented a report before Supreme Court that reopening of Swiss cases was a closed chapter.
Justice Nasir-ul-Mulk remarked that 14 judge bench of the apex courtÂ’s directions to the Government regarding implementation of NRO were much clear. Justice Fayyaz also inquired what kind of confusion had left after 16th December SCÂ’s verdict. But he insisted that he wanted to apprise the court regarding implementation of NRO verdict. On the other hand, the bench replied that Attorney General was present in the court for this purpose.

Addl DG FIA arrested from court premises


ISLAMABAD – The Supreme Court on Tuesday while giving Ahmad Riaz Sheikh, who was promoted by the Federal Government as Additional DG FIA Criminal Wing in a criminal way, into police custody for completion of his sentence awarded by the Lahore High Court in the NAB reference cases, set another deadline of 24 hours for implementation of its December 16th verdict on the National Reconciliation Order (NRO).
On the order of the apex court, police arrested the Ahmad Riaz Sheikh from the courtÂ’s premises and shifted him to the Secretariat Police Station. Later, he was shifted to the Adiala Jail Rawalpindi.
The court directed Chairman NAB to reopen all such cases pertaining to the NRO within as well as outside the country without any fear or hesitation. Chief Justice remarked that Mr Chairman today the whole nation was asking him that where had gone their money, which was collected from them in the name of tax. The court directed the NAB Chairman not to waste any more time in seeking advices from anyone else and ensure the implementation of apex courtÂ’s verdict in its letter and spirit.
A six-member larger bench comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Chaudhry Ijaz Ahmad, Justice Shakirullah Jan, Justice Asif Saeed Khan Khosa, Justice Tariq Pervez and Justice Khalilur Rehman Ramday while hearing this case has restored the punishment of five-year imprisonment term and fine amounting to Rs 20 million. In its order, the apex court asked the NAB to confiscate the property of Ahmad Riaz Sheikh within three days and file a report with the Registrar office of Supreme Court.
Chairman NAB Naveed Ahsan informed the court that 167 cases had been revived after the verdict of the apex court on the NRO. When the court enquired from the Chairman NAB regarding the details of these cases, he told that not a single case was reopened outside the country. He informed the court that immunity in the Constitution for the President restricted him from writing a letter to Swiss Government. On this, the CJ asked him not to mention name of anybody. The court directed the Chairmen NAB to do his work as per the SC verdict and write a letter to the Swiss Government, as no one had come to the court, so far, to claim immunity.
Earlier, the court had issued contempt of court notices on Chairman & Acting Chairman of the National Accountability Bureau (NAB), DG FIA, Secretary interior, Raja Ahsan, and Secretary Establishment for not implementing its NRO verdict accordingly. These officials explained their position before the court but the court observed that these explanations were not satisfactory. The court asked these officials to submit written explanation regarding contempt of the court notices today (Wednesday).
The Secretary Law also appeared before the court and explained his position in this regard. The court observed that the Law Ministry did not take a single step to implement the apex courtÂ’s order. The court asked the Secretary Law to ensure filing of a reference against former attorney general Malik Muhammad Qayyaum, removal of Prosecutor General of NAB (Dr Danishwar Malik) and increase in the numbers of accountability courts and submit report in SC on Wednesday (30-03-2010).
Justice Ramday inquired from the Secretary Interior and DG FIA that there was no one except ‘dacoits and criminals’ eligible for the promotion. “Why you promoted an acquitted official even after the NRO judgement of 17-member SC bench”. Rashid A. Rizvi, counsel of Riaz Sheikh, sought time from the bench saying that it had granted two-week time to others in the cases registered under the NRO and he could not find time to go through a very lengthy record. When his request was turned down, he said that he would be unable to plead the case and therefore, he was separating himself from the case.
In its first written statement for withdrawal of his petition, he wrote that he was doing so because senior officials were humiliated by the court. On this, Justice Ramday remarked that such kind of drama would not be allowed to scandalise the courts.

ISLAMABAD – Supreme Court on Monday while issuing contempt of court notices on Chairman and Acting Chairman of the National Accountability Bureau (NAB) set 24 hours deadline for implementation of its December 16th verdict on the National Reconciliation Order (NRO).
In its order, the apex court observed that no one was above the law and it did not matter if one was a king. The court directed the Chairman NAB to reopen all such cases pertaining to the NRO within as well as outside the country without any fear or hesitation. The court directed the NAB Chairman not to waste time in writing letters to the Law Minister or Attorney General and only follow the apex courtÂ’s judgement in this regard.
A six-member larger bench headed by Chief Justice Iftikhar Muhammad Chuadhry and comprising of Justice Chaudhry Ijaz Ahmad, Justice Shakirullah Jan, Justice Asif Saeed Khan Khosa, Justice Tariq Pervez and Justice Khalilur Rehman Ramday heard a number of the NRO related cases, which stood revived after its decision on December 16 last year.
The court summoned the Acting Chairman NAB, DG FIA, Secretary Interior, Joint Secretary Establishment in the court for not implementing the apex courtÂ’s verdict in letter and sprit and issued show cause notices on them and asked them to explain their position before the court on Tuesday (today).
The bench observed that the SC gave appropriate time of four months to the Parliament to decide the fate of NRO but in the TV talk shows and newspapers all were criticising only judges and seeking reforms for the SC instead of implementing its verdict accordingly.
The court asked the Acting Chairman NAB to explain what authority was preventing him form complying with the courtÂ’s orders and as to why the cases had not been reopened so far. If a king is involved, he would have to come to pre-NRO position, it observed. Pakistan is only country in the world where the judges make requests for implementation of their orders, the court further observed.
During the course of hearing of a case pertaining to Ahmad Riaz Sheikh, the CJ observed that it should be made clear why the cases had not been reopened against him so far. The bench ordered the Acting Chairman NAB to submit detailed report and directed him to appear before the court Tuesday (today). “They want to hush up everything, nothing will happen to them but you will have to go behind the bars,” the court told the Acting Chairman NAB.
The court asked why the cases had not been reopened so far against Ahmad Riaz Sheikh, Additional DG Economic Crime Wing of FIA, while he was acquitted in the serious corruption charges. The Interior Secretary should tell the court why Ahmad Riaz was promoted, the bench inquired. The court has also issued orders for confiscation of the property of Ahmad Riaz Sheikh.
It is relevant to mention here that Rashid A. Rizwi, President Sindh High Court Bar, was the counsel of Ahmad Riaz Sheikh and the CJ suggested him not to appear before the court as advocate of the criminal people like Ahmad Riaz Shiekh.

The bench also heard the NABÂ’s appeals for revival of cases against Ghani-ur-Rehman, former MPA from Kohat, Abdul Aziz Memon, Ashiq Babar, Haji Gulshair, Aftab Ahmed Khan Sherpao, former interior minister, Akhtar Rasool and Hashim Khan etc and adjourned hearing for two weeks.
The bench also heard a case relating to revival of the NAB case against Jahangir Badar, PPP Secretary General. Mohammad Akram Sheikh, his counsel, apprised the bench that his case stood revived from last December in the accountability court.
Jehangir Badar apprised the bench that he never sought for taking benefits under the NRO rather he contended on merits of the case. The bench disposed of his case. The bench also queried acquittal of Aamir Lodhi in the NAB cases and directed the NAB Acting Chairman to produce him before the court.

11 killed, dozens injured in Muzaffarabad suicide hit


MUZAFFARABAD (Agencies) – At least 11 people were killed and dozens injured in a suicide bombing that ripped through an Imambargah in Azad KashmirÂ’s main city on Sunday.
The suicide bomber detonated his explosives in a Muharram procession in Muzaffarabad. “When the volunteers spotted the suicide bomber and challenged him, he blew himself up,” local religious leader Maulvi Kifayat told a private TV channel.
Raja Kafil Ahmad, spokesman for the Azad Kashmir government, said 11 people had died while more than 65 were injured.
One witness said he saw body parts on the street believed to be those of the suicide bomber.
“It was a suicide attack. The bomber was trying to enter inside the Imambargah. Several people have been injured. I fear some people may be dead,” police official Yaseen Baig told AFP at the scene.
A severed leg and other body parts littered the ground outside the Imambargah where the electricity went off after the blast, said an AFP reporter.
Meanwhile, President Asif Ali Zardari and Prime Minister Syed Yousuf Raza Gilani have strongly condemned the suicide blast in Muzaffarabad, Azad Kashmir on Sunday, which caused loss of precious lives and injuries.
In a statement issued in Islamabad, the President and the Prime Minister in separate messages expressed their resolve not to be deterred by such acts of cowardice and to take all measures to eliminate extremism and terrorism from the country.
The two leaders expressed their deep sorrow over the loss of life and directed the local authorities to provide best possible treatment to the injured.
