SC returns govt’s NRO review plea


ISLAMABAD – The Ministry of Law and Justice will file a review petition with additional grounds tomorrow (Thursday) in support of an already filed review petition against the Supreme Court’s December 16 decision on the National Reconciliation Ordinance (NRO), challenging the verdict from various aspects, reliable sources told TheNation.
Earlier, the SC Registrar Office on Tuesday returned the petition with technical objections on it. Advocate on the Record (AoR), Raja Abdul Ghafoor sent the objections to the Ministry of Law and Justice here on Tuesday.
Earlier, the Federation filed a review petition on 16th January against the short order of the apex court in the NRO case, arguing that the court failed to consider the doctrine of past and closed transactions while giving the verdict on December 16, 2009.
It is pertinent to mention that the Federation had not defended the NRO in the apex court saying that it was promulgated by the former chief of army staff, Pervez Musharraf to prolong his rule. After the courtÂ’s decision, the Federation had expressed its reservations over the verdict, saying that the apex court had gone beyond what was requested by the petitioners.
Raja Abdul Ghafoor, Advocate on the Record, while talking to this reporter, said that the Law Ministry would remove the technical objections pointed out by the Supreme Court and file the review petition with additional grounds and club it with the already filed petition. The legal minds of the Law Ministry including Attorney General of Pakistan, Anwar Mansoor Khan prepared a petition on solid grounds to meet the objections raised by the court and would file it tomorrow (Thursday), the Ministry sources told this scribe.
The additional grounds would address various points of the verdict including the court gave this verdict beyond the points mentioned in the petitions and did not hear the GovernmentÂ’s point of view on the Swiss cases, the sources added.
It is also worth mentioning here that in light of apex courtÂ’s verdict, over 8,000 criminal and corruption cases against bureaucrats and politicians were reopened. In this context the court directed the Federation that the cases against President Asif Ali Zardari pending before the courts in Switzerland should be reopened through a letter to the Swiss authorities.

Judiciary bound to get its verdicts implemented: CJ


ISLAMABAD – Chief Justice Iftikhar Muhammad Chaudhry has said that manifesto of good governance cannot be implemented without the provision of justice, as judiciary was duty-bound to provide speedy justice to every citizen.
The Chief Justice was addressing a full court reference held at Supreme Court premises in the honour of outgoing SC Judge, Justice Sardar Muhammad Raza Khan, on Tuesday.
The CJ said that all the state organs must perform their respective duties according to constitutional scheme and ineffectiveness of any organ would result in lack of good governance.
The CJ said that the judiciary was duty-bound to get its verdicts implemented and uphold the rule of law. He said the notion that the administration of justice was the sole duty of courts or legal fraternity, was wrong.
“Due to such a wrong notion, allied institutions have started feeling relaxed. As a result good governance is being compromised,” he added. He said, “Judiciary’s duty is to preserve and protect the Constitution, interpret laws, enforce fundamental rights and to settle disputes. The establishment of a civilised society is not possible without independent, impartial and efficient judiciary.”
He said that a sound judicial system and good governance were key factors in stability and economic growth of the country. He said the judiciary was fulfilling its manifesto carefully by drawing its attention on important and even complicated issues, and its dedication to answer all points raised in the cases pending in the courts.
Later, in his dedication to Justice Raza Khan, the Chief Justice said he had rendered justice at its best, without fear or favour. In this way Justice Raza has contributed a lot towards upholding the rule of law and supremacy of the Constitution, he added.
“His services in advancing the cause of justice shall be remembered for years to come and will continue to provide immense benefit to the country,” the Chief Justice said. He said that Justice Raza was one of the stalwarts of the system of administration of justice.
“Whether Justice Raza spent a successful life or otherwise, it would be least known to him but what we can feel is that as a judge of the superior judiciary he has incredible record to his credit,” the CJ recalled.
Admiring the services of Justice Raza, the Chief Justice said, “I had opportunities to work with him after his elevation to this court during which I found him to be a balanced and perfect person. He has brought a unique combination of talent and experience to ensure highest quality of decision-making.
On this occasion, Attorney General for Pakistan, Anwar Mansoor Khan, Chairman Executive Committee Pakistan Bar Council, Ch Nasrullah Warraich, and President Supreme Court Bar Association, Qazi Muhammad Anwar, paid glowing tributes to the outgoing judge.
They acknowledged the services of Justice Raza Khan towards his professional commitment and contribution in conformity with the rule of law and Supremacy of Constitution and added that commendable services of his lordship would always be remembered in the judicial history of Pakistan.
The Attorney General emphasized that efforts should continue for provision of speedy and quick justice to weaker segments of the society. He said that history of the country showed that judiciary, one of the three pillars of the country, was the weakest of all, adding that it (judiciary) neither had control over ‘sword’ nor national kitty. He further said that independent judiciary helped provide justice to people.
Separation of the judiciary from the executive was the necessary to make it strong, he added. The AG said the judiciary had authority to issued judgements, while it would have to depend on the executive to get its verdicts implemented.
Justice Sardar Muhammad Raza Khan thanking to all participants said, “A judge now has to take notice of all pillars of the state. In my very humble view, the time today is much more difficult than what it was three or four decades ago.”
During the last three years, the judiciary has undergone a lot of crises and that is why the judicial norms need to be guarded, he said. Earlier, Dr Faqir Hussain, Registrar Supreme Court of Pakistan conducted the proceeding of full court reference.

SC dissatisfied with Malik’s reply


ISLAMABAD – The contempt of court proceedings against Interior Minister Rehman Malik is a fit case of executive’s interference in judicial affairs of the state, observed Chief Justice Iftikhar Muhammad Chaudhry.
The Chief Justice was hearing a suo moto notice against Interior Minister in Pakistan Steel Mills (PSM) case here on Monday.
“We have never interfered in the working of the Parliament or the Interior Ministry. Why did the said Ministry interfere in the working of the Supreme Court of Pakistan (SCP),” the Chief Justice explained.
Malik did not show any repentance on his action in the written reply submitted before the court, the court observed.
“So, we have the right to proceed against you (Malik) according to the Law,” the Chief Justice said.
The SCP took contempt of court proceedings against Interior Minister Rehman Malik when he had formed a joint investigation team in December 2009 to probe corruption in the PSM. He reportedly violated the orders of the apex court, which had already formed a committee to probe the whole scam.
But the apex court said that it was satisfied with the investigation of the Federal Investigation Agency (FIA).
Malik appeared before the court here Monday to explain why this was done even though the FIA was investigating the case.
Earlier in last hearing, he was given time by the apex court to file a written reply with regard to his contempt of court notice. A two-member bench of the apex court headed by Chief Justice heard the case. Justice Ghulam Rabbani was the other judge of the bench.
During the course of proceedings, Malik defended his position in a letter saying he was committed to tackling corruption on the floor of the Parliament and that the FIA did not have the expertise for the case. “Since the FIA did not have the expertise to handle audit cases, therefore the joint investigation team was formed,” Malik explained.
Chief Justice intended to continue the proceedings against Malik in contempt of court notice as he himself admitted that he had ordered to constitute a committee.
“I did not violate the court order deliberately,” Malik said adding, “I had no intention of disrespecting the court.”
The apex court was not satisfied with the MinisterÂ’s explanation and directed the Attorney General of Pakistan, Anwar Mansoor Khan to ensure Rehman MalikÂ’s presence at the next hearing on February 18.
The court was ready to proceed against the Minister on Monday but it could not continue its proceedings against him owing to absence of the AGP who was not present in the court.
Then, after ten minutes, Deputy Attorney General Shah Khawar informed the court that the AGP was in Lahore, as he was not summoned in the case here.
Chief Justice said, “You (Malik) have no idea how much the PSM corruption case suffered because of you.”
Malik further informed the court that FIA was not eligible to audit Steel Mills therefore they were hiring a foreign firm.
In reply, the Chief Justice said conducting audit of Steel Mills is not within the authority of the Interior Minister.
Meanwhile, the court was informed that Director FIA Sindh Meer Zubair was being sent to Lahore for an official course.
On this point, the court expressed its concerns over this step of Government saying the matter will take up, as he will have been moved from Karachi to Lahore.
Meer Zubair Khan also apprised the bench that out of total 16 accused, six had been on bail while further legal action was taken against others in line with laws.
He said comprehensive reports about estimate of raw material used in the Mills and its rates in the market were also being furnished which would be submitted to the court.
The court also inquired from Zubair what would be the method of recovery of national wealth totalling Rs 22 billion in the PSM scam?
Chief Justice sought institution help in recovery of the national wealth saying, “It should be recovered at all costs.”
Malik said that he himself ordered to audit PSM, which has not been done by the authorities concerned for five years.
Malik also justified that an investigation team was constituted in reaction to the news reflected in the print media which gave an impression that the apex court had reportedly expressed dissatisfaction over the inquiry report submitted by FIA.
Later, the court adjourned the hearing till February 18 after Malik pleaded for a lawyer.

Karachi shut: Blast toll rises to 45

KARACHI – At least 45 mourners were killed and 80 others wounded, some of them seriously when a suicide bomber blew himself up in the main Ashura procession on Monday afternoon at Light House traffic signal on MA Jinnah Road, the main traffic artery of the metropolis.
The incident sparked riots in the City in which three main markets and 60 vehicles were torched. The blast occurred when a Rangers personnel tried to stop the suspected bomber when he tried to join the procession. The CCTV of the City Government caught the moment when the bomb went off, throwing into air a large plume of dust and smoke, creating panic among the mourners who were on their way to Imama Bargah Husainan-e-Iranian, Kharadar from Imambragh Shah Khursan located near old Numaish.
The alleged bomber was said to be between 18 to 20 years of age, wearing black shirt and jeans tried to join the procession when he was intercepted by the law enforcer, who was also among those killed.
The law enforcing agencies had thrown a blanket of red plus security ring around the route of the procession and approximately 15,000 law enforcers and a number of sharp shooters had been posted on the building of the route of the procession. Sophisticated CCTV cameras were installed to monitor the route.
Police claimed that Musharf Baig, a traffic constable deployed at the link road signal saw suspect bomber first and signalled a Boy Scout namely Muzamil and Ranger personnel Abdul Razaq to intercept him. Abdul Razaq and Muzamil both were trying to intercept the bomber when it went off with a big bang, killing scores of people and injuring many others.
The bomber, the Boy Scout and the Rangers personnel all perished on the spot.
Ambulances of the various welfare organisations rushed to the spot and carried victims to different hospitals of city including Civil Hospital, Jinnah Postgraduate Medical Centre and Abbasi Shaheed Hospital.
Witnesses said that place of incident was littered with dead bodies and injured and the whole places was splattered with blood.
They said that victims were rushed to Civil Hospital where doctors and paramedical staff initially were not available. The rescuers immediately shifted a number of injured to private hospitals.
Bomb Disposal Squad official Munir Sheikh said that some 16 kg high-intensity explosives were used in the suicide attack. Police officials, however, claimed that as the suicide bomber was not wearing the explosive jacket, his upper part of the body remained intact and most of the injured received pellets in the lower parts of the bodies.
Enraged people accused that the incident took place because of the security lapse. The first reaction of the angry crowd was against the deployed security personnel and miscreants snatched rifle from the cops and beat them severely.
In the melee that ensued, the law enforcers backed off in order to avoid confrontation. Meanwhile, miscreants resorted to firing and law enforcement personnel also resorted aerial firing to disperse the violent mob.
Unknown miscreants took advantage of the situation and torched more than 60 vehicles including the police mobile vans. The infuriated crowd torched various big markets in the downtown of the city.
Protesters also set ablaze two buildings at Light House market and ransacked shops including an arms shop. Police and paramilitary troops fired in the air to disperse the angry crowd. The unknown miscreants also used firearms which resulted in two deaths.
The blast created tension in different parts of the city including Ancholi society, Malir Jaffer Tayyar, Gulistan-e-Jauhar, Rizvia, Orangi Town, Shah Faisal colony where unknown armed men resorted to aerial firing.
Meanwhile, three main markets, 60 vehicles were torched in violent fallout of Ashura procession. CountryÂ’s biggest medicine and plastic wholesale markets were burnt to ashes by miscreants, causing loss of billions of rupees.
The miscreants vandalized the whole of M.A Jinnah road from Light House to Boultan market, setting on fires thousands of shops that came in their way.
The traders claimed that they suffered loss of Rs30 billion. An arms shop was looted. The miscreants also used the looted arms on law enforcers and some of the innocent civilians fell prey to their firing.
The vehicles torched by the angry mob included police and RangersÂ’ mobiles besides cars, ambulances, KESC while six banks were also torched in the city.
The complete Light House market and adjacent market known as paper market having around 1000 shops were set on fire while Bolton Market and other adjacent markets having over 1500 shops were also been torched.
Interestingly, despite the tragedy, the mournersÂ’ procession continued to move forward despite the explosion and it concluded at Hussainain Iranian Imambargah at Kharadar. Fire tenders were unable to reach the spot because the procession was moving toward its destination after the blast.
It is pertinent to mention here that fire tenders were unable to extinguish the fire in last 24 hours.
Meanwhile, thousands of mourners attended the funeral prayers on Tuesday of five victims of the suicide blast which occurred in the main Muharram procession on Monday at Numaish.
The funeral prayers was led by Sheikh Salahuddin. The mourners chanted slogans against the US and Taliban but the crowd remained peaceful.
The huge procession went to two main graveyards from the University Road.
Two persons were buried in Wad-e-Hussain graveyard, while three bodies were taken to Mewa Shah graveyard. Seven bodies were sent to Chakwal, while two out of seven would be sent to Skardu later.
A body was buried in Korangi, while his funeral prayer was held separately. The suicide bomb blast had killed 43 innocent people so far while scores of others were injured.
Besides police and the Rangers, the volunteers of ISO and Imamia Scouts were deployed in and around the Shah Khurasan Road to handle any untoward incident. All mourners were allowed entry only after thorough physical search.
Lack of transport in the City forced large number people to arrive at Mehfil Shah Khurasan on foot. Hundreds of Ulema from across the country and politicians from different parities attended the funeral prayers.
Prominent participants of funerals included ISO Central Vice President Rehman Shah, Jafariya Alliance Chief Allama Abbas Kumeli, Allama Agha Aftab Haider Jaffery, Allama Hasan Zafar Naqvi, Allama Taqi Shah, Maulana Mirza Yousuf Hussain Mirza, Mulana Ghulam Abbas Raisi, Maulana Jawad Naqvi.
Renowned social worker Abdul Sattar Edhi also attended the funeral, while Deputy Speaker Provincial Assembly Shehla Raza, Provincial Interior Minster Dr Zulfiqar Mirza, Adviser to Chief Minster Waqar Mehdi, President PPP Karachi Najm-e-Alam, Secretary General PPP Karachi Saeed Ghani, Deputy Convener MQM Rabita Committee Dr Farouq Sattar, Provincial Minister Rashid Godial and Town Nazim Jawed Ahmed Khan also attended the funeral prayers.
Speakers at the funeral prayers termed the blast a conspiracy against Islam and the country initiated by US and the Taliban.
They demanded the government to hold judicial probe of the suicide blast and violence after the blast.
During the funerals prayers Shiite Ulema and different organisations also condoled with those newsmen whose family members were also killed in the blast.
