US gets ‘no’ on NWA action


ISLAMABAD – Pakistan on Wednesday made it clear to the US that it would not become a part of any new American great game in relation to its forcesÂ’ announced withdrawal from Afghanistan starting from July this year.
Officials requesting anonymity told The Nation that Islamabad had also conveyed to the visiting US Vice-President Joe Biden that neither politically nor strategically it suited Pakistan to open up any new war front in North Waziristan Agency.
Biden, who held separate meetings with President Asif Ali Zardari, Prime Minister Yousuf Raza Gilani and COAS Gen Ashfaq Parvez Kayani, assured the Pakistani leadership that the US fully respected sovereignty of Pakistan.
He assured Pakistan that there would be “no boots on the ground”. He also dismissed Pakistan’s apprehensions about US-sponsored foreign intervention thorough Afghanistan.
Acknowledging Pakistan’s legitimate apprehensions, the visiting dignitary made it clear that the US wanted Pakistan’s key role in bringing peace in Afghanistan. He rather acknowledged Pakistan’s apprehensions about foreign intervention through Afghanistan as “legitimate”.
Terming these meetings as extremely useful high-level consultation, the sources said that both the sides discussed how to proceed forward on matters related to Afghanistan.
They opined that the US was interested in finding out “Pakistan’s bottom line and its intentions” regarding Afghanistan.
They said both sides also discussed possibilities of Afghan TalibanÂ’s future political role and agreed that if they disassociated themselves from al Qaeda and would be acceptable, at all
The US Vice-President arrived in Islamabad after two days in Kabul, where he said Pakistan needed to do more to help the US in its battle against Taliban and other militants in Afghanistan as it prepares to withdraw its troops from there.
Earlier, addressing a joint Press conference with Premier Gilani following their one on one meeting at the Prime MinisterÂ’s House, Biden rejected misperceptions that the US planned to impose any war on Pakistan as part of its counter-terrorism fight against al Qaeda. He reassured that the US wanted to forge long-term strategic partnership with Pakistan.
“A stable, prosperous and democratic Pakistan was in the interests of the US,” the US Vice-President said.
Calling the Pak-US relationship “absolutely vital”, he said that was what he had experienced in his capacity as member of Foreign Relations Committee during his 30-year long interaction with Pakistani leadership.
He said it was an opportunity for him to do away with some misperceptions about US-Pakistan relations.
He said his country’s aspirations for Pakistan was to see it a developed and a prosperous country. “I want the grandchildren of Pakistan and US not to find in future the articles on terrorism. I want the Pakistani scientists to accomplish Nobel peace prizes,” he said.
The US Vice-President said due to USÂ’ interest to forge deeper relations with Pakistan, it had set up a large educational system for Pakistanis and demonstrated this by actions during the last seven years by initiating numerous projects.
He said the US was working in partnership with Pakistani Government and had increased security cooperation.
Biden pointed out that during the last summer’s devastating floods in Pakistan, the US made extensive support for relief and rehabilitation. “This is what the partners do for partners,” he added.
About misconception regarding USÂ’ disrespect towards Islam, the US Vice-President said the situation was in fact quite the opposite as the Muslim Americans freely practised their religion in the US.
He attempted to dispel what he called common anti-American misperceptions in Pakistan while urging the government to fight growing religious extremism.
He said Islam was the fastest growing religion in the US and mentioned President Barack Obama’s statement in a Muslim-populated area that “Islam is a part of America”.
“I would challenge to name any other country in the world which provides greater freedom of worship. We are not the enemies of Islam and we embrace those who practice this great religion,” he said.
He said a large number of people were converting to Islam in America.
Biden called Amna Taseer, the widow of the slain governor, to express his condolences on behalf of the president and the American people.
Biden said militancy in Pakistan was a threat to both countries, adding that IslamabadÂ’s efforts against militants were not enough.
Militant groups have exploited grievances, exacerbated by US drone attacks in the west of the country, to build support.
He said President Barrack Obama, he and his countrymen were saddened over the assassination of Punjab Governor Salman Taseer, adding that there was no justification for such senseless act against a person who raised voice for tolerance.
While offering condolences over TaseerÂ’s killing on behalf of President Obama, he said that societies needed tolerance to grow.
“The governor was killed simply because he was a voice of tolerance and understanding,” he said.
“As you know all too well … societies that tolerate such actions end up being consumed by those actions,” he said, urging Pakistan for NWA operation
Biden said militancy in Pakistan was a threat to both countries, adding that IslamabadÂ’s efforts against militants were not enough.
In his opening remarks, Prime Minister Gilani thanked the US administration for its extra-ordinary contribution to the relief and rehabilitation efforts for the people and areas affected by the recent unprecedented floods in the country.

Justice JavedÂ’s parents killed


LAHORE – Malik Abdul Hameed, former DIG Police and father of Supreme Court judge Justice Javed Iqbal, along with his spouse was found strangled to death at their Cavalry Ground residence in Cantonment police area late on Tuesday night.
Police sources claimed that the possibility of target killing could not be ruled out.
Sources further said the couple, in their early 80s, was tortured and strangled to death in their house located in the posh and fortified locality. The policemen deployed outside their residence 164-Cavalary Ground were absent from the duty. The motives behind the murder are yet to be ascertained, but nothing from the luggage was missing, raising suspicions, a top police source said. Both Malik Abdul Hameed, 85, and his wife Amna Hameed, 80, were lying dead on the floor in the courtyard of the lower portion when the police reached there.
A woman residing on the upper portion of their house on rent found the couple dead and informed the police about the gruesome murder incident.
“Two female neighbourers phoned the police, which reached the spot and detained the both for preliminary investigation,” insiders said. They further said as the women were the first eyewitnesses of the incident, they would be interrogated regarding the incident.
Investigators were on the scene, collecting evidences to determine how the killers brutally murdered Malik and his wife.
Apparently, the killers suffocated former DIG Special Branch Quetta Abdul Hameed and his wife to death by putting pillows on their faces. “We are trying to find out motives behind the killings. Nothing is clear at this moment,” the source said.
Justice Javed Iqbal, a close associate of Supreme Court Chief Justice Iftikhar Muhammad Chaudhry who had refused to take oath under PCO, was in Islamabad while his parents were staying alone at their Lahore residence. The Punjab Bar Council announced strike for Wednesday (today) and lawyers will not appear in the courts to protest the killings.
Sources said Criminal Investigation Agency (CIA) SP Umar Virk had got a tip-off that a gang would break into the locality some days back on which the CIA, in collaboration with the Lahore Police teams, had started surveillance of the area and deployed personnel at several locations.
Days after the newly-appointed IG Punjab Javed Iqbal assumed charge of his new office and spelt out his priorities to bring down the alarming crime rate, dacoits have killed the parents of a senior Supreme Court judge Justice Javed Iqbal.
The police have arrested the street guard and are investigating.
The news got many grave ramifications for the judges and their families after this incident took place.
It is worth mentioning here that the horrible incident has come at such a critical situation when the SC judges are being considered the only ray of hope and the only working institution for the deprived people across the country.
The dacoity-cum-murder incidents have swelled to an alarming level in Lahore as the dacoits killed 55 people on offering resistance last year.
Chief Minister Punjab Mian Shahbaz Sharif took strong notice of the incident and directed IGP Javed Iqbal to nab the killers.
The Chief Minister of Punjab, the Chief Justice of the Lahore High Court, the Inspector-General of Police, the Commissioner, the DCO Lahore and provincial law minister were also on the crime scene till the filing of this report.
The police denied the media access to the crime scene and cordoned off the entire locality.
Meanwhile, Interior Minister Rehman Malik constituted a Joint Investigation Team comprising ISI, FIA, IB and Punjab Police to probe into the ghastly murder incident.
President Asif Ali Zardari, Prime Minister Yousuf Raza Gilani, PML-N Chief Nawaz Sharif, PML-Q President Ch Shujaat Hussain, PTI Chairman Imran Khan and JamaÂ’at-i-Islami Ameer Syed Munawar Hassan and former Ameer JI Qazi Hussain Ahmed strongly condemned the killing of the parents of Justice Javed Iqbal.
Premier Gilani directed the Joint Investigation Team to investigate the sad incident and submit a report at the earliest. The Prime Minister conveyed his heartiest condolences and sincere sympathies to the members of the bereaved family.
President Zardari also strongly condemned the tragic happening and ordered immediate inquiry into the incident. He expressed his deep sense of shock and grief over the tragic deaths and prayed to Allah Almighty to rest the departed souls in eternal peace and grant courage to the bereaved family.

PM says ‘yes’ to Nawaz agenda


ISLAMABAD – Accepting the 10-point demands a day ahead of the ‘so-called ultimatumÂ’ given by Pakistan Muslim League (Nawaz), Prime Minister Syed Yousuf Raza Gilani said that in his telephonic contact with Mian Nawaz Sharif he had assured him that government would not lose the opportunity of steering the country out of crises on implementing his agenda.
He was addressing the press conference at Prime MinisterÂ’s House soon after talking to Nawaz Sharif assuring him that government was ready to implement his agenda for bringing improvement in governance.
Before his chat with Nawaz Sharif, Prime Minister Gilani secured approval of the same from President Asif Ali Zardari and also took into confidence the parliamentary leaders including PML-Q President Ch Shujaat Hussain, MQM chief Altaf Hussain, PPP-S President Aftab Ahmad Khan Sherpao, Functional League head Pir Pagara, JUI-F chief Maulana Fazlur Rehman, ANP President Asfandyar Wali Khan and FATA MPs leader Munir Orakazi. All these national leaders have endorsed the decision of Pakistan PeopleÂ’s Party and hence it has acquired the shape of national agenda, Premier added.
To a question Prime Minister said that he did talk about the ultimatum given to his government by Nawaz Sharif but he said that he was quoted out of context and he had not given any ultimatum. Premier further said that after expressing the governmentÂ’s affirmative response on 10-point demands of Nawaz Sharif he once again put the question about the next deadline of 45 days but Main Nanas Shari said that as the government seemed sincere in implementing the 10-point demands put forth by him for sprucing up the governance so there was no more deadline.
Nawaz Sharif further said that as the government wanted to implement his agenda for putting the house in order so there is no question of showing the door to Pakistan PeopleÂ’s Party in Punjab, Prime Minister quoted Nawaz Sharif.
Prime Minister Gilani further informed that on his suggestion Nawaz Sharif had agreed to form a Parliamentary Committee under the head of Senator Ishaq Dar to take up the issues concerning PML-N with government in furthering 10-point agenda given by Mian Nawaz Sharif which he termed ‘national agenda.’
Prime Minister said that PPP would definitely take PML-N on board while appointing new Governor Punjab when asked whether PPP would take into confidence while appointing this important administrative slot in Punjab.
To a question Prime Minister Syed Yousuf Raze Gilani said that his government was already working on the same lines to bring improvement in governance and to control leakage of funds from various corporations and state owned enterprises.
He said that the restructuring of Pakistan Railways, PIA, Pepco and Steel Mills was already on the agenda and in next cabinet meeting they would be going to discuss the ways and means to bring improvement in these state entities running into losses.
Prime Minister Gilani said that his government was pursuing the policy of reconciliation and referred to the unanimous passage of 18th Amendment, 19th Amendment, 7th NFC Award, political status granted to Gilgit-Baltistan and reforms package for Balochistan and termed it a result of the policy of reconciliation adopted by Pakistan PeopleÂ’s Party and expressed his partyÂ’s resolve to pursue the same in future as well.
To a question Premier Gilani said that in achieving these goals would only be possible through the active support of all the stakeholders in the Parliament and it was singular honour of the incumbent Parliament that it had done most of the legislation with consensus and hoped that they would be able to steer the country out of prevailing economic mess in same spirit of politics of reconciliation.
To another question about the following of Supreme Court verdicts Prime Minister said that PPP was having the singular honour of complete adherence to the each and every verdict of the apex court.
When his attention was drawn toward the governmentÂ’s non-implementation of NRO verdict of SC he replied that it was sheer bias when people talk about only one case out of 8,034 cases withdrawn under NRO and added that still the case on NRO is subjudice in the apex court and let the court take decision on the review petition of the government.
To another question about the fresh spate of target killing in Karachi he said that PPP in support of MQM and ANP would definitely bring normalcy to the port city which is the economic hub of the country and disturbance over their would have negative impact on the whole economy.
To a question about the allegations of corruption coming on his family members including his son in Haj scam Premier Gilani termed them as mere allegations and quickly added that the case of Haj scam was in the court and if someone have substantial proof he could submit the same in the court.
To a question about some of his wrong decisions Prime Minister said that out of over 10,000 decisions he had taken if some four or five decisions were wrong and said that it could be taken as error judgment. As the matter relating to some appointments were in the court of law and whatever would be the decision of the court it would be implemented in totality.
Responding to another question Prime Minister Gilani said that actually the persons who are hurling corruption allegations on him were targeting President Asif Ali Zardari and as he was defending him so they had also turned against him.
He further said that as President was the part of Parliament so it was his duty to defend him and this thing annoyed certain quarters, which had launched dirty campaign against him.
To another question he said that incumbent political dispensation was not going anywhere as for the first time in the history of the country the establishment was supportive of the political set-up and it was also for the first time that PPP and establishment were on one-page.
To another question he once again reiterated his governmentÂ’s stance that they would not bring any change in the blasphemy laws and added that during his chat with him Maulana Fazlur Rehman had also asked him about it and his reply was the same that government would not bring any change in the law.

ISI chief wonÂ’t face US court


ISLAMABAD – Terming the issuance of summons to the ISI chief by a US court sensitive matter, Prime Minister Syed Yousuf Raza Gilani on Thursday said that the decision pertaining to it would be taken after mutual consultation.
Responding to remarks of Opposition Leader in the National Assembly, Ch Nisar Ali Khan, Premier Gilani said, “I will not give any statement on this issue today. It’s a sensitive matter. No one can send the ISI official to the US court if ISI itself is not willing to go.” The Government is as sensitive to the issue as the other political leadership of the country are, he added.
Talking about the law and order situation in Balochistan and the handling of Shah Zain Bugti by the security agencies, the Prime Minister said that the security agencies should not go beyond their limits and he assured the House that he would talk to Interior Minister Rehman Malik who would take the House into confidence on the issue. However, he added that the matter was a provincial subject.
The Prime Minister said the foreign elements were interfering in Balochistan and the Parliament would have to collectively draw a strategy to handle it. He also assured the House that the Government would take the House into confidence on the summons issued to ISI and Balochistan issues.
The Premier also responded to JUI chief Maulana Fazlur RehamÂ’s remarks, who earlier on the floor of the House alleged that the Government was working on USÂ’ dictations and opposed the military operation in the North Waziristan.
Syed Yousuf Raza Gilani brushed aside the allegations and said that the decision to launch operation would be taken after the consultations with the political leadership of the country. “The economy of any country is based on law and order. Our agenda is to improve economy and law and order. There is no international pressure on the Government. It’s our own problem,” Gilani said.
Talking about the operation in North Waziristan, he said that nobody could dictate the Government. People of Pakistan would decide that where and when the operation should be launched, he added.
Opposition Leader Nisar Ali Khan on the floor of the House said that the Foreign Ministry should strictly respond to the news item regarding summons issued to the ISI official. “We will not let any Pakistani institution to become a slave of any international institution. It’s a political decision of US court to pressurise Pakistan”, the Opposition Leader said. He added that the way security agencies arrested and handled Shah Zain Bugti was condemnable and they should work within their limits.
He also came hard on the Government on the presence of CIA chief in Pakistan. Nisar said that Pakistan was not a Banana Republic and no spy of any country was allowed to carry out activities in any other country. He asked the Government to tell the nation whether or not there was an agreement allowing the US to carry out such activities, adding that if there is such agreement then ISI should also be allowed to carry out operations in the US. He said that the US Government should itself oppose the decision of its court.
Earlier, JUI chief Maulana Fazlur Rehman flayed the Prime Minister on the removal of Azam Swati from the Cabinet and said that the Premier should first consult him before taking any step against Swati.
“Swati was not a member of PPP. If it is a constitutional right of the Prime Minister that he can remove somebody on the ground of poor discipline then it was also a part of discipline that he should have first consulted me. We can be friends of the Prime Minster but we cannot be the peasants of Premier Gilani,” Fazal said.
He added that when Muhammad Khan Junejo removed Yousuf Raza Gilani from his Cabinet, he on the very next day called Benazir Bhutto and joined PPP.
He said, “We had cautioned the Government that if it did not go for Islamic legislations, JUI-F would quit the Government but at that time the Government assured us that the agreement would be implemented but it did nothing in this regard. Swati’s removal became an cause for leaving the treasury benches,” the JUI-F chief revealed.
Elaborating the situation in Pakistan, he said that the US was pressurising Pakistan for launching operations in North Waziristan and IMF was also putting pressure to bring so-called economic reforms. He added that the Government was working on the US’ dictations while the Parliament was carrying out legislating under the international pressure. He also came hard on Iranian President Ahmadinejad and said that he was an “inspector” of the region as he called President Zardari to hand “his terrorists” over to him. He also warned the US that if it tried to attack North Waziristan it would have to face more bitter consequences than it faced in Afghanistan.
Talking about the military operation in Swat and Malakand Division, he said that the Army was still handling the affairs of these areas and the Government had failed to hand over administration of these areas back to the civil authorities, adding that the provincial Government could not even transfer a policeman.
“Obtaining the rights through gun is not right but what the people will do when the democratic institutions would not provide justice to them in accordance with Sharia. We are also criminal that we cannot give them justice in accordance with Islam. I am not a threat to democracy but you are a thereat to Islam,” he added.
Highlighting the achievements of Kashmir Committee of the National Assembly, he said that the Government had fully changed the Kashmir policy but it was the Kashmir Committee, which restored the old policy and it was the efforts of the Committee that after a long time the Foreign Minister could discuss Kashmir issue in United Nations.
“We were informed just a month before Obama’s visit to India and his announcement to support India for the permanent membership of UN Security Council. We immediately started meetings with diplomats to make them understood that India never respected the decisions of the Security Council and it could not become its permanent member. Finally, Obama had to announce that he wished India to become UNSC permanent member rather than announcing his support to India,” Maulana Fazlur Rehman told the House.

19th Amend sails smoothly through NA


ISLAMABAD – The National Assembly on Wednesday passed the 19th Amendment Bill with a majority vote as 258 votes were polled in its favour while only one vote was cast against it.
Earlier, the Federal Cabinet approved the draft of 19th Amendment Bill, after which it was presented in the National Assembly. Chairman Parliamentary Committee on Constitutional Reforms, Senator Mian Raza Rabbani, introduced the bill in the Lower House of the Parliament for approval. On his request, the Speaker National Assembly after taking census of the House dispensed the rules for consideration of the Bill comprising seven clauses that mainly deal with the appointment of judges.
When the Bill was presented for consideration, 239 members of the Lower House voted in favour while Kashmala Tariq of PML-Q (Likeminded) cast her vote against it. However, she did not oppose even a single clause of the Bill. Later, she said that she favoured all the clauses of the bill but the issues like procedure of making new provinces and democracy within the parties should also be addressed in the 19th Amendment Bill as the Government had earlier assured this to her party. She also suggested formation of some more committees to appoint capable people in the institutions to ensure national progress.
Earlier, elaborating the 19th Amendment Bill, Mian Raza Rabbani, while terming it a landmark in the history of the country, said that the Parliament believed in the freedom of judiciary. He added that the apex court had sent the clause 175A of the 18th Amendment back to Parliament for review.
He said that the Committee reviewed the Supreme CourtÂ’s order in detail on a number of occasions and each reservation of the Supreme Court was reconsidered. Rabbani said that the Bill gave effect to certain amendments in the Constitution after giving consideration to the observations of the Supreme Court. The fresh Amendment seeks changes in a two-pronged mechanism for appointing judges in the superior courts in the light of proposals forwarded to the Parliament by the Supreme Court in its order.
He said that under the 19th Amendment Bill, the number of members of a Judicial Commission for appointment of judges was increased from two senior most judges to four senior judges and for the nomination of Pakistan Bar Council member in the commission no less than 15 years of experience was required. Later, the Speaker National Assembly announced the passage of the Bill.
Prime Minister Syed Yousuf Raza Gilani later congratulated the House and said that there was an impression that the institutions could never work together but today the Parliament and political leadership with their political sagacity had proved that institutions could work together.
“In the past, amendments were made in the Constitution to empower the rule of an individual but this amendment has been made to strengthen the institutions, Constitution of Pakistan and the vision of Quaid-e-Azam to form a parliamentary system. It has balanced the judiciary and the Parliament. We have proved that we respect judiciary,” Premier Gilani said. He also announced highest civil award for Mian Raza Rabbani for his services.
Responding to Kashmala Tariq, Gilani said if somebody thought that there were still some issues to be resolved then this was not the end, adding that the names for the committee were given by the party leadership and every body should have confidence in their leaders. He brushed aside the impression that 19th Amendment was brought due to the pressure of the Supreme Court.
Ahsan Iqbal of PML-N was of the view that the 19th Amendment had dispelled the mistrust between the Supreme Court and the Parliament. Judiciary respects the Parliament while the Parliament has proved that it does not want any clash with the apex court, he added. He also suggested that some more committees should be formed to appoint officials on institutions with transparency and merit.
Maulana Attaur Rehman of JUI-F and Pervaiz Khan of ANP, Sheikh Waqas Akram of PML-Q and Abdul Qadir of MQM also congratulated the House on the passage of the 19th Amendment and termed it a landmark development.
Earlier the Federal Cabinet Wednesday unanimously approved the Draft 19th Constitutional Amendment Bill for presentation in the Parliament. The Federal Cabinet meeting chaired by Prime Minister Gilani adopted a single point agenda to timely present the Bill in the National Assembly session.
During the meeting, a proposal was also made to discuss the relations of the Government with its coalition partners Muttahida Qaumi Movement and JUI-F, said a source privy to the meeting. While, the Prime Minister said that these issues would be deliberated in the upcoming Cabinet meeting, said a source quoting the PM.
Gilani termed the consensus evolved on the Bill as yet another historic achievement and congratulated the Chairman and the members of the Parliamentary Committee on Constitutional Reforms.
Earlier, Mian Raza Rabbani briefed the Cabinet about the salient features of the Draft 19th Constitutional Amendment Bill and the proceedings of the parliamentary committee. He read out the 19th Constitutional Amendment Bill clause by clause which were unanimously approved by the Cabinet.
Agencies add: Consisting of seven clauses, the Bill mainly deals with appointment of judges, addition of four-member senior judges of Judicial Commission and addition of Islamabad High Court in the list of higher judiciary.
The House passed the bill through division of votes made to determine the actual number of votes in favour and against the amendment.
The Bill proposes 26 amendments in six Articles of the Constitution. The Amendment proposes inclusion of four judges in the Judicial Commission instead of two. The legislation also proposes to withdraw the powers of the Chief Justice with regard to appointment of ad hoc judges in higher courts and handing over the same to the Judicial Commission. The Bill also suggests at least 15-year experience for the representative of provincial bar that will represent the body in the Judicial Commission.
Before the final acceptance of the bill, Rabbani addressed the House and clarified that the right of appointment of ad hoc judges was not taken away from the Chief Justice, he would still make the appointment but with the consultation of the Judicial Commission which was not a part of the previous constitution, as per the new Bill the Chief Justice will not forward the names to the Parliamentary Committee but to the Prime Minister through Judicial Commission and from there the names of the ad hoc judges will be forwarded to President for approval.
He said when the 18th Amendment was approved a lot of hue and cry was raised on Article 175 and a petition was submitted against it but all the government bodies kept on working according to the Constitution and despite of all this 18th Amendment Bill was passed in the Parliament unanimously.
As per 19th Amendment Bill, articles 213, 182, 175, 81 and 246 have been amended, and IHC after the amendment in Article 175 has been added. He said the report by the Parliamentary Committee on Constitutional Reforms has increased the number of members of a judicial commission formed for appointments under the 18th Amendment.
By amending Article 175-A, Judicial Commission has raised the number of the judges from 2 to 4 and for the nomination of the bar council member in the commission no less than 15 years of experience is required, Islamabad High Court(IHC) will also be given representation.
It was informed that as per Article 68, now the appointment of judges in the Parliamentary Committee meeting will be recorded which previously happened in closed rooms. By making amendments to the 18th Amendment Bill a balance has been created in the powers among President, Parliament and Prime Minister, and provinces have been given autonomy.
Rabbani said, “We believe in freedom of justice and give a lot of respect to the judiciary, and democracy cannot move forward without the freedom of justice.”
He said this was a unique moment in the political history of the country that two very important constitutional bills are being presented unanimously in the House in 2010.
He said the top political leadership had dispelled fears of confrontation among state institutions as the Lower House of Parliament prepared to amend the constitution for a second time in a year and this time in compliance with a Supreme Court order. “All those who were predicting confrontation among state institutions will be disappointed today,” Rabbani told lawmakers.
While complimenting the role of members of constitutionals reforms committee and all political parties, he said that no dissent note was surfaced in the 19th Amendment.
He said all the political parties also showed political sagacity and evolved consensus for national interests. He said all the constitutional organisations are functioning in their constitutional domain and political system is strengthening day by day.
Speaking in the House, Prime Minister Yousuf Raza Gilani termed the passage of 19th Amendment Bill a `very big decisionÂ’ of the Parliament that reflected that the government respected judiciary. He said the Bill would pave the way for future legislators to avert any clash of institutions. It underscored that each institution must pay respect to the other, he added.

Unanimous 19th Amend lands in NA


ISLAMABAD – Terming the day a historic one, Chairman Parliamentary Committee on Constitutional Reforms, Mian Raza Rabbani Tuesday presented a report with regard to the proposed 19th amendment in the Constitution in the National Assembly.
“This is a unique moment in the political history of the country as two very important unanimously adopted constitutional bills are being presented before the House,” he said while laying the report. Rabbani said that when some of the articles of the 18th Amendment were challenged in the Supreme Court of Pakistan, some people were waiting for a clash among the institutions but the Supreme Court sent it back to the Parliament for a review. No political party has given a dissenting note on the 19th amendment, he added.
He congratulated and thanked the President, the Prime Minister, all political partiesÂ’ heads and the National Assembly Speaker for giving a free hand0 to the Committee, which made it possible for him to present a unanimously adopted report on 19th amendment in the House.
He said that all the constitutional institutions were functioning within their constitutional ambits and the political system in the country was strengthening day-by-day. He also paid tributes to the members of the Committee and said without their active cooperation, it was not possible for him to develop consensus with regard to the unanimous amendments.
Later, Prime Minister Syed Yousuf Raza Gilani congratulated the House on the presentation of the report with regard to the report on 19th amendment and a successful test of a ballistic missile Hatf-5.
He was of the view that the incumbent Parliament was the most independent than the previous ones and its seriousness and devotion to resolve the issues had shut the mouth of those who had been terming it a rubberstamp parliament.
Premier Gilani said that he had been a member of the parliament since 1982 to 2002 and he never saw such an independent parliament. “The last Parliament did nothing but only chanted slogans of ‘Go Musharraf Go,” the Prime Minister commented.
Congratulating the Chairman and members of the Committee and heads of the political parties, he said that the Parliament, politicians, media and judiciary were passing through an evolution and were turning more mature and strong.
“I compliment the role of Supreme Court for referring the matter to the Parliament for a review. The Judiciary has given highest respect to the Parliament and the Parliament has
reciprocated in the same manner,” he said.
PML-Q leader Riaz Pirzada said the ParliamentÂ’s maturity strengthened political institutions and the unanimous resolution had cemented the democratic system. Aftab Shaikh of PML-N said it was a historic day when the Committee had drafted a unanimous amendment, which would help restore the 1973 Constitution in its true form.
However, Kashmala Tariq of PML-Q (Likeminded) and Bahadur Khan Sehar of PML-Q and Nawab Yousuf of PPP said that the procedure of making new provinces in the country should be relaxed in the 19th amendment.
Meanwhile, Chairman Standing Committee on Religious Affairs Maulana Muhammad Qasim presented a report of the committee on ‘The Registration of Haj Bill, 2008’. The Bill provides for regulating, controlling and facilitating the business of Haj operators.
Earlier, responding to a calling attention notice, the Minister of State for Foreign Affairs said that Sikhs were not refused of visa to visit pilgrims on the occasion of their founderÂ’s day in Pakistan.
He said that he had checked the matter from Interior Ministry and there was no report of the refusal of visas to 300 Sikh pilgrims. The calling attention notice was moved by MNAs Shakeela Khanam, Rubina Saadat Qaim Khani, and others.
According to the draft of the report, it has been recommended that Judicial Commission would nominate judges and send its nominations to the parliamentary committee, that would have the authority to reject the same and send it back to the Commission for review. The Commission would again nominate other judges for appointment and would send it back to the parliamentary committee, that would send the nomination to the prime minister for appointment.
The channel said 26 amendments have been made in six articles of the Constitution. Two in article 81, one each in article 175 and 182, 12 in article 175A, two in article 213 and eight amendments made to article 246.

The Chairman of the Parliamentary Committee on Constitutional Reforms (PCCR) Senator Mian Raza Rabbani had tabled the report of the Committee before the National Assembly on Tuesday.
Sources in the Parliament informed The Nation that the draft of 19th Constitutional Amendment would be presented before the Federal Cabinet on Wednesday (today) for approval and once it was okayed by the Cabinet it would be tabled before the National Assembly on Thursday and is likely be passed by the Parliament the same day.
Agencies add: According a TV channel said 26 amendments have been made in six articles of the Constitution. Two in article 81, one each in article 175 and 182, 12 in article 175A, two in Article 213 and eight amendments made to article 246.

JUI-F quits coalition


ISLAMABAD/LAHORE – The PPP-led government suffered another setback as it plunged to another crisis Tuesday when JUI-F chief Maulana Fazlur Rehman announced Tuesday that his party had decided to quit the coalition government.
The latest twist in the countryÂ’s politics came after Prime Minister Yousuf Raza Gilani earlier in the day sacked Minister for Religious Affairs Hamid Saeed Kazmi and Minister for Science and Technology Azam Swati from their offices. It is worth mentioning that Swati was one of the three JUI-FÂ’s ministers who were inducted in the cabinet.
As soon a high-level meeting of JUI-F made the decision, the remaining two ministers also sent their resignations to the prime minister.
They include Federal Minister Housing and Works Minister Rehmat Ullah Kakar and Federal Minister for Tourism Atta-ur-Rehman.
After the announcement, President Zardari and Premier Gilani telephoned Fazlur Rehman but he refused to talk. When asked about the contact by the Presidency, Fazl while talking to media said, “Please avoid such critical questions.”
He said the governmentÂ’s one-sided decision compelled them to quit the coalition government, adding that they were not taken into confidence over issue.
The JUI-F chief said he had responded positively to the reconciliation policy of the PPP Co-Chairman Asif Ali Zardari, adding that he asked the president to implement the agreement reached with the JUI-F which had joined the government on the basis of the deal.
He said the party had written many letters to Prime Minister Gilani to take action against the people involved in the Haj scandal but the government did not take any action. Instead, it dismissed their minister Azam Swati who stood firm against the huge corruption in Haj operations, he added.
When asked about the blasphemy law, he ridiculed Punjab Governor Salmaan TaseerÂ’s statements about amending the law and expressed his anger over the private bill moved by PPP MNA Sherry Rehman for this purpose.
In response to a question, he asked the PPP government to revoke the notification of SwatiÂ’s removal and issue a formal apology.
About the future plan of action and RGST Bill which would soon be tabled in the Lower House of the Parliament, Fazl said the JUI-F would oppose the bill and would not bail out the govt from the possible embarrassment during the voting.
Later, as a reconciliatory move, President ZardariÂ’s spokesman Dr Qayyum Soomro reached FazlÂ’s residence for convincing him to withdraw his decision.
Meanwhile, talking to media after a religious ceremony at Kala Shah Kaku near Lahore, Kazmi said a particular group was conspiring against him after his appointment as the federal minister for Religious Affairs. They wanted to grab the ministry, he added.
Talking about his removal, Kazmi said the decision had been taken although there was no solid proof against him but he had no complaint over the move.
“I am simple man and not involved in any corruption,” he said.
He said fabricated stories were being spread just for targeting him.
When asked why he did not resign despite constant pressure, Kazmi replied he wanted to stand up against the conspirators and there was no reason to do so in the absence of concrete evidence.
He reminded the reporters that no accused could be termed criminal till the charges were proved in the court.
On the reports of freezing his bank accounts, Kazmi he had no wealth; therefore, the decision, if taken, would not affect him.
In an exclusive telephonic conversation with Nawa-i-Waqt from Zurich, Azam Swati described his removal as an honour, saying he was the lone minister in Pakistan who had ever been sacked over pointing out corruption.
He said he was grateful to Maulana Fazlur Rehman and other party elders for deciding to quit the govt after his expulsion from the cabinet. He also thanked the people and media for, what he called naming, him as the ‘honest minister’.
“This day will always be remembered as an important milestone in the country’s history,” he remarked, adding that it had inculcated a new feeling in the nation.
It was a JUI-F minister who exposed corruption prevailing in the government, he said.
Swati said the incumbent govt never paid attention to science and technology, as the budget of Higher Education Commission (HEC) was slashed while that of BISP, which he termed as bogus, was increased from Rs30 billion to Rs90 billion. He had walked out of the cabinet meeting when it was approved, Swati added.
The JUI-F senator said he would stay in Zurich at his daughterÂ’s house and also land in Dubai for some days.
It is pertinent to recall that Swati runs a departmental store chain and oil companies in the US where he had stayed till late 1990s but later opted to return to Pakistan.
Talking to media, Federal Minister for Information Qamar Zaman Kaira said obviously there were some differences between the two allies but the matter would soon be resolved amicably.
Though the PMÂ’s House statement about the sacking of the two ministers did not mention any reasons but they have been fired over the controversy about the corruption in the Haj operations. Kazmi is facing serious allegations of corruption in Haj levelled against him by Swati and others. It resulted in media war as both the ministers did not follow the premierÂ’s advice to avoid issuing statements, thus aggravating the differences between the two cabinet fellows.
Prime Minister Gilani has given the additional charge of Religious Affairs to Syed Khursheed Shah, Minister of Labour and Manpower Minister of Education Sardar Assef Ahmed will look after the Ministry of Science and Technology.
The premier has also appointed Makhdoom Shahbuddin as Minister for Defence Production, who will continue to hold his portfolio of the Health Ministry. The slot was vacant after the resignation by former minister Abdul Qayyum Jatoi.

Qazalbash has been directed to report to the Establishment Division, while Secretary Overseas Pakistanis Division Saeed Khan has replaced Qazalbash.

PM moves to calm fraying tempers


ISLAMABAD – Prime Minister Syed Yousuf Raza Gilani directed the Minister for Religious Affairs and Minister for Science and Technology to stop giving statements against each other, as an inquiry had already been initiated to fix the responsibility of malpractices in the Haj arrangements.
Following Federal Minister for Science and Technology, Azam Khan SwatiÂ’s statement holding Federal Minister for Religious Affairs, Hamid Saeed Kazmi, responsible for all the mismanagement and corruption during the current Haj and a tit-for-tat by the latter by filing damages sue against the former, Prime Minister Gilani intervened in the matter and directed both the ministers to stop washing each othersÂ’ dirty linen in public to the disadvantage of the already corruption-tainted Government.
Sources aware of the development informed TheNation that Premier Gilani during his telephonic contact with Hamid Saeed Kazmi further directed him to keep his hands off in the blame game and let the matter be settled with Saudi Government at government-to-government level.
In his chat with Azam Khan Swati, the PM asked him to avoid giving any further statement against the person of Federal Minister for Religious Affairs and let the inquiry report come on the overall mismanagement and malpractices in the Haj arrangements.
The sources further said that Hamid Saeed Kazmi briefed the Prime Minister about some of the issues relating to Haj mismanagement and the problems faced by the Pakistani pilgrims but Premier Gilani directed him to present a detailed report to him covering all the issues relating to the subject.
It is pertinent to mention here that Federal Minister for Religious Affairs, Hamid Saeed Kazmi, had served Federal Minister of Science and Technology, Azam Swati, with Rs100 million defamation notice for levelling allegations against him regarding the Haj scandal.
According to media reports, Hamid Saeed Kazmi said that if Azam Swati had any proof he should make it public and charged that following the passage of 18th Amendment a number of ministries would be abolished and that was the reason a few of the ministers were eying on his Ministry and wanted his ouster.
Federal Minister for Science and Technology, Azam Khan Sawati, a JUI-F leader, was the first to hold Federal Minister for Religious Affairs, Hamid Saeed Kazmi, for lousily handling the Haj affairs.
Agencies add: On Sunday, while addressing a ceremony in Mansehra, Swati demanded removal of Federal Minister Saeed Kazmi for poor arrangements and corruption scam during Haj.
“He (Kazmi) is responsible for robbing the pilgrims and mismanagement, and he should be removed,” he remarked while adding that no official could even imagine to do anything wrong without the consent of the minister concerned.
Premier Gilani asked Kazmi to refrain from issuing statements to media, saying, “It is a critical issue and we don’t want any kind of confrontation,” adding, “These statements are contrary to the country’s integrity.”
The prime minister said shifting of responsibility and the ongoing blame game were unacceptable, adding that the Foreign Ministry would in future coordinate all the arrangements for the Haj as had been decided by the cabinet.
He expressed profound appreciation for the excellent arrangements that the government of the Saudi Arabia has always made for the pilgrims. But promised to deal the corrupt elements with an iron hand.

PM admits governance problems


ISLAMABAD – Conceding the governance and corruption problems with his government like most of the developing states Prime Minister Syed Yousuf Raza Gilani said that they were introducing reforms in various sectors and steps were underway to address the hiccups like mal-governance and other hurdles coming in the way of democratic government.
Speaking at Pakistan Development Forum in Islamabad on Monday, Prime Minister Gilani said that Pakistan was confronted with terrorism and on top of it devastation by unprecedented floods had inflicted loss of billions of dollars to the national exchequer.
Premier Gilani said that his government was ready to take unpopular decisions to meet the long-term challenge of reconstruction of infrastructure in flood-hit areas and to help resettle the affected people in their homes.
He said flood reconstruction would require billions in investment, while the countryÂ’s institutions also need to be reformed.
“We need your long term, consistent support in helping us support our institutions, our systems, so together we can continue on a journey which would make Pakistan, and its people, realise their full potential,” Gilani said.
He said his government believed in leading the people through painful yet fundamental reforms.
“We are prepared to take political risks for providing the necessary leadership to our people. We have demonstrated our will to take unpopular decisions. However, our resolve to lead our people to a glorious tomorrow is unflinching,” the Prime Minister told the gathering of delegates from 30 countries and 264 representatives from donor countries.
Prime Minister Syed Yousuf Raza Gilani said Pakistan deeply appreciated the support and warmth of friendly countries and its bilateral and multilateral partners.
He said the extreme difficulties that the people of Pakistan, have faced over the last three years have “tested our resolve as a nation, our courage, our determination, our resilience.”
“We as a nation have proven our resolve, our courage and determination, our resilience.”
He said the destruction of lives and property, by the floods has been met through the benevolence of fellow Pakistanis, swift government action and timely international humanitarian support.”
Gilani acknowledged the services of the soldiers, government servants and NGOs for meeting the challenge of floods with devotion and diligence.
He, however, acknowledged the measures needed to meet the losses of billions of dollars and said, “We need to collect more revenues, require policy and tax administration reforms, promote growth and create employment opportunities.”
The Prime Minister said in an environment badly damaged by floods, and by frequent attacks by terrorists, the people must not lose hope.
“We want to give our people especially our youth, a message of hope,” Gilani said, but was critical of those who were projecting a completely negative image of Pakistan and called for a distinction between criticism of a government and criticism of the country.
“We are democrats and believe in freedom of speech. However, when such criticism envelops the nation then it is a cause of concern for all of us. All Pakistanis love Pakistan! We in government are also Pakistanis and we too love Pakistan.”
He elaborated and said, “Some choose to only look at our faults, and not at our achievements.”
Gilani said Pakistan has embarked on the way to help itself and pointed to the consensus on the 7th National Finance Commission Award and the 18th Amendment.
“We have committed ourselves to a timeline to reduce ministries at the federal level as enshrined in the 18th amendment. Ten ministries will be reduced shortly. The Council of Common Interests has been constituted and made fully functional,” Gilani said.
The Prime Minister said the government was now activating the public sector reform, required under the 18th Amendment.
He said his government was firmly committed to the economic reform agenda and change to improve economic governance in the country. He said the government was facing the challenge of raising domestic revenues and mentioned the measures that included introducing the Reformed GST in the Parliament.
He said to rationalise expenditures, his government removed the general subsidies and replaced these with targeted subsidies for the poor and vulnerable.
A social safety net was created through a transparent and technology driven response via the Benazir Income Support Programme, rehabilitation of the Malakand IDPs and the CitizensÂ’ Damage Compensation Programme.
He said a reform programme was being pursued to achieve a better level of governance.
“Please consider this as work in progress. Kindly be patient with Pakistan. We are a plural society trying to come to grips with our economic and social ethos. We look towards you for understanding and support.”
He said Pakistan was a large country, of more than 180 million people and remarkable diversity.
“Therefore, change would not come because of donor support to a few programmes. Your support and commitment is required over a much longer period, during which we can channelise your assistance towards institutional and structural reforms,” the Prime Minister said.

PM rules out clash among institutions


ISLAMABAD – Ruling out the possibility of clash between the institutions, Prime Minister Syed Yousuf Raza Gilani has said that his Government would continue following the path of reconciliation with the aim to promoting the mutual respect amongst the state institutions.
Addressing the nation on Sunday evening, Prime Minister Syed Yousuf Raza Gilani said if the Government could work with Armed Forces and evolve consensus among the political forces then it could also work with judiciary to take the country forward and provide speedy justice to the masses.
Flanked by the Chief Ministers of Khyber Pakhtunkhwa and Balochistan, AJK Premier, Chief Minister Gilgit-Baltistan, and Senior Ministers from Punjab and Sindh, Prime Minister Gilani said that the elected leadership from all the four provinces, AJK and Gilgit-Baltistan was sitting with him and it was the dividend of their policy of reconciliation. He, once again, reiterated his GovernmentÂ’s resolve to take all the stakeholders on board for the collective good of the people of the country.
He stressed the need for collective endeavour on part of the Government and judiciary for the provision of legal, social and economic justice to the people, for which his Government was ready to sit with judiciary to evolve some viable mechanism. “For provision of justice to people I am ready to take any step and whatever suggestion will come up in this regard, my Government will welcome it,” he added.
Referring to the false news about withdrawal of judgesÂ’ restoration notice, he said it was immediately denied by him and President Zardari too had termed it false but even then it was not accepted and it could be the violation of the principles of mutual respect among the institutions. And it was tantamount to insulting the very Office of Prime Minister.
The Prime Minister said that he had ordered inquiry into the news report that caused all the mess so that the nation might know who had conspired to harm the relations between the judiciary and the Government.
Recalling the release of judges soon after his nomination as the Leader of the House, Premier Gilani said, “If I announce restoration of the judges, it is accepted. Similarly, if I deny a news, then keeping in view the stature of the position, it too should be accepted by all forums.”
“If a false news is given preference over the words of the Prime Minister, it would be an insult to the stature of the Prime Minister,” he remarked.
“If the Government and judiciary take steps together then we can administer justice to the poor people of the country. We can counter forces of oppression. We can bring those to justice, who usurp rights of people.”
Gilani said that as a public representative, he understood the need of justice. He called for improvement in administrative and judicial system. He vowed to take every step for provision of justice to people and said the Government would welcome any suggestions in the cause of justice.
Premier Gilani reminded when he decided to restore judges through an executive order he was told that he could not do it and it would be a violation of the Constitution and the action could come under Article 6.
“But I did not listen to those voices. I did not give any importance to any danger and announced restoration of judges,” he said, adding, “I was also told that validation of Parliament was necessary for the Executive Order. I referred to this in one of my speeches that people were saying this to me but I stood by my decision. But this speech of mine was given different meanings. I made it clear at that time that I had not given my opinion but only explained the background in which I took that decision.”
The Prime Minister reminded the nation that they were living in a parliamentary democratic system, which stood on the principle of division (of power) and mutual respect. “This (democracy) teaches us respect for every state institution including judiciary, legislature, executive and media,” he said.
The Prime Minister said that this system also provided respect for the Armed Forces and law enforcing institutions, whose men sacrificed their lives for countryÂ’s defence; for executive, which maintained the countryÂ’s administrative affairs by working day and night; and for Parliament, which did legislation.
“The Prime Minister is said to be the Leader of the House in this system and deserves respect,” he added.
“The words of the Prime Minister, be it verbal or written, are respected. If he utters verbally that the house arrest of judges should be ended, they could not be kept confined. If he (the Prime Minister) announces the restoration of honourable judges, that is accepted,” Gilani said.
Shedding some light on his GovernmentÂ’s achievements, which he also attributed to their policy of reconciliation, Prime Minister Gilani said that they had brought the provinces together and consensus NFC Award was signed.
Similarly besides restoring the original shape of the Constitution, the passage of 18th Amendment had enhanced both the monetary and administrative powers of the provinces.
They in support of the provinces had declared war against price-hike and would come down hard on profiteers and hoarding mafias. He also announced the GovernmentÂ’s plan to reorganise eight public sector institutions so that their financial burden on the national exchequer could be reduced. He also referred to their efforts, which resulted in European Union allowing access to Pakistani goods in their markets.
He also gave a brief resume to the GovernmentÂ’s efforts for the rehabilitation of the flood-affected people and also thanked the international community, which had come all-out in aid to the Government of Pakistan in handling this calamity.
He, once again, reiterated his GovernmentÂ’s unflinching support to the people of Kashmir and said that they would continue highlighting the ongoing unprecedented programme of the innocent Kashmir people at the hands of Indian forces.
About the Accountability process he said that being a politician they were subjected to accountability at various stages: first at the time of their nomination papers with the returning officer where even a default of a utility bill could result in their disqualification; the second stage was public accountability who could vote them out; and the third stage was Public Accounts Committee of the Parliament.
He further said that they were working on mechanism of transparent accountability and as soon as the Parliament would evolve consensus on it, the same would be given the shape of law.
He said that they would complete their mandated term and would go to the court of masses in 2013 to seek their justice.
He also reiterated his partyÂ’s stance that they would continue to follow the path of politics of reconciliation to evolve harmony and cohesion among the state institutions and political forces.

Pak warns NATO against more incursions


ISLAMABAD – Prime Minister Syed Yousuf Raza Gilani has warned that the Pakistan will explore every available option if NATO does not apologise for violation of its territory.
Responding to a point of order in the National Assembly on Friday, Prime Minister Gilani said PakistanÂ’s cooperation with NATO and US in the war on terror does not mean that Pakistan has compromised on its sovereignty. “War on terror is our own war and we are fighting it to curb the menace of terrorism from our country,” Premier Gilani added.
He said the government has raised the issue with NATO in accordance with international principles. “We have discussed it with Senator Kerry and it will also be raised in Brussels,” Prime Minister told the House.
He said Pakistan has intelligence, defence, political and economic cooperation with the US and if the allied forces have any credible information regarding terrorist activities they should share it with Pakistani authorities.
The Prime Minister made it clear that any violation of Pakistani territory is not acceptable and the government will not allow anyone to violate its security and sovereignty.
Earlier, MNA Abdul Qadir Baloch on the point of order urged the parliamentarians to register their protest against NATO attacks, adding that the House should pass a resolution against this violation.
Responding to another point of order, Prime Minister Gilani said government believes in across-the-board transparent accountability and does not believe in political victimization.
He reiterated that the government intends to pass new accountability bill through consensus and it is working to build a consensus among all stakeholders in this regard.
He said during previous regimes NAB was working under the Chief Executive of the country and he himself became its political victim.
“As I did not want an impression of influencing NAB on my part, I better decided to give NAB under the Law Ministry for the sake of justice,” he stated.
Gilani however said as per the law, the President has to consult the leaders of the House and Opposition for the appointment of Chairman NAB. “I, on behalf of the President, have proposed two names to the Opposition Leader on which he has reservations.” He said keeping in view the situation, the government requested the Supreme Court to extend time for appointment of Chairman NAB to complete consultative process for this purpose.
He told the House that no ordinance is promulgated without the permission of the Prime Minister.
Earlier, Mahtab Abbasi on the point of order while quoting a news item expressed his concern over the promulgation of an ordinance designating the powers of Chairman NAB to Law Ministry.

Gilani urges more talks with India


LAHORE (Agencies) – Prime Minister Syed Yousuf Raza Gilani Saturday called for more dialogue with India, a day after Foreign Minister Shah Mehmood Qureshi accused New Delhi of limiting a talks process.
Gilani said he believed India remained committed to the talks. “We want dialogues, they (India) too want dialogues, so when there will be talks then we will discuss all issues. At this point I cannot say something in the air,” Gilani told reporters after an official function at Balloki, near Lahore.
“They (India) had told us that they want to talk on all issues and I am sure that Indian prime minister is an honourable man and he will fulfil all his commitments,” Gilani said.
Gilani said that Manmohan Singh had assured him that all issues between the two countries would be discussed. He was referring to the meeting between the two in Thimphu on the sidelines of the SAARC summit in April.
Gilani said Pakistan wanted good relations with India and both countries were sincere in improving ties. He was talking to the media after inaugurating an independent power plant with generation capacity of 225 MW.
“It was our desire that India along with its people and we along with our people hold talks to improve relations between the two countries.”
To a question, the PM said that he had good relations with the judiciary and one can also ask from the Chief Justice of Pakistan about it.
Regarding the murder of BNP leader Habib Jalib Baloch, he said that law and order was a provincial matter and he had talked to the Balochistan Chief Minister who, he said, had ordered a judicial inquiry into the matter. The Prime Minister said that PPP did not believe in politics of violence and condemned it.
To another question, the premier said that the PPP government did not believe in victimisation and that was why there was not even a single political prisoner in the country in the PPP government.
To a question, he said, “The HEC chairman wished to meet me and I will soon meet him to know about his problems.” He said the HEC chairman’s brother was not being victimised as the PPP did not want to earn a bad name.
To yet another question, the prime minister said that wishes of mid-term polls would not be fulfilled and wherever anyone was disqualified, by-polls would be held.
He said that terrorists were beasts and talks could not be held with them, adding that talks were held with human beings.
Regarding terrorism in Punjab, the Prime Minister said, “whole Pakistan is ours and terrorism is a collective issue. And where there is terrorist we will take action.”
Earlier, addressing the inaugural ceremony of 225 MW Orient Combined Cycle Power Plant, Gilani said the government had prepared a comprehensive plan to double the power generation capacity within next ten years by initiating projects that could add a minimum of 20,000 MW by the year 2020. He said the plan was in addition to the projects already under construction.
Gilani said, “20,000 MW addition would comprise 6,000 MW on hydro, 6,000 MW on coal, 5,000 MW on gas, 1,000 MW on Naptha and other indigenous fuels while the remaining 2,000 MW from alternative energy resources, especially solar and wind.”
The prime minister said while translating the vision 2020 into reality, the govt had so far added a total of 1,708 MW through a combination of hydel and thermal sources, which included rehabilitated capacity of the existing Generation Companies (GENCOs), adding that another 2,795 MW of capacity additions were likely to be completed by December this year with an investment equal to US$ 5 billion.
He said, “We will ensure maximum efficiency gains in our generation, transmission and distribution systems.”
Gilani said the government would add to conservation drive through induction of energy savers, solarisation of water heating and irrigation pumps.
He said the 225 MW Orient Combined Cycle Power Plant was the fifth one after the Attock Power, Atlas Power, Nishat Power and Korangi Combined Cycle Power Plant launched by the present government in just one and half year.
He appreciated the intention of the sponsors to launch the second phase of the plant after confirming the gas supply.
Referring to the constrained gas supply, the prime minister said the govt had been making earnest efforts to import gas from the neighbouring countries, which would primarily be dedicated to the power sector.
Gilani thanked the primary sponsors of the project, including the
OmanÂ’s govt through Oman Oil Company and the German govt through Development Finance Institution (DEG).
“We cherish our relationship with both the friendly countries and projects like these are a demonstration of our commitment to foster economic ties amongst our respective govts,” he remarked.
Premier Gilani said most of the projects being implemented had been financed with local bank debt, which in the longer term was good for the economy because it reduced foreign exchange burden.
He said the focus on the countryÂ’s indigenous resources would not only decrease the burden on balance of payments but also lower the cost of power generation and provide the much-needed relief to the people.
“We also intend completing the projects designed to import hydro electricity from Central Asia and other countries as a part of low-carbon strategies,” he added.

National policy to fend off terror


ISLAMABAD – Prime Minister Syed Yousuf Raza Gilani, in consultation with all the four Provincial Governments and AJK Government, has formally announced to convene All Parties Conference (APC) soon for evolving national strategy against the menace of terrorism.
Addressing an Inter-Provincial Conference held at PMÂ’s Secretariat on Monday to review law and order situation of the country, the Prime Minister said that all political and religious parties would be invited to attend the conference.
“As a first step we would like to convene a national conference to formulate a national policy on terrorism,” he said and added that all the major political parties of the country whether or not they were in the Parliament would be requested to participate in it and bring tangible suggestions to eradicate the scourge of terrorism from our society.”
The meeting was attended by Chief Ministers of Punjab, Sindh and Balochistan, Federal Ministers, Home Ministers of the provinces, Prime Minister Azad Jammu and Kashmir, DG ISI, heads of law enforcement departments and other concerned high officials. Information Minister Khyber Pakhtunkhwa Mian Iftikhar attended the meeting on behalf of his Chief Minister who did not turn up owing to illness.
Premier Gilani said that the political and religious parties would be requested to give suggestions to tackle the menace of terrorism. He reiterated that neither the Federal nor the Provincial Governments alone could deal with this challenge. Therefore, he said, besides the Army and law enforcing agencies, the terrorism, sectarianism and ethnic divide need to be handled by the important pillars of the state including public representatives from the all political parties, religious leaders and civil society.
The Prime Minister said that after successful operation in Khyber Pakhtunkhwa and FATA, the terrorists were now targeting cities as soft targets and killing innocent people. He directed Federal and Provincial Governments to streamline and enhance sharing of intelligence information with one another.
The Prime Minister has also appealed to the nation to get united against terrorism and extremism, adding terrorists had no religion and nationality. He said that the Government was determined to completely eradicate terrorism and would never bow before terrorists, adding no one would be allowed to challenge the writ of the Government.
Condemning suicide attack on Data Darbar, Gilani said that the recent wave of terrorism was a matter of concern for entire nation, saying people of the country were in shock from Karachi to Gilgit-Baltistan after the attacks.
The meeting was convened in the aftermath of the twin suicide blasts at the shrine of Hazrat Ali Hajveeri alias Data Ganj Bakhsh in Lahore. The meeting thoroughly reviewed the security situation and more stern steps are likely to be taken to curb militancy.

NA okays budget amid ‘N’ boycott


ISLAMABAD – The National Assembly on Friday passed the Budget 2010-11 with consolidated outlay of Rs 3,259 billion, however the PML-N walked out of the House and termed the budget one-sided fiscal policy.
Following the passage of the budget as well as the Finance Act 2010 with simple majority, the Government also got approval of supplementary demands for grants amounting to Rs 424.4 billion for the current fiscal 2009-10, while Minister of State for Finance Hina Rabbani Khar also presented the details of supplementary charged expenditures of Rs 39.59 billion in the House.
Earlier, Minister for Finance Abdul Hafeez Sheikh moved the Finance Bill 2010 in the Lower House to give effect to the financial proposals of the Federal Government for the year beginning on the first day of July, 2010 and to amend certain laws (The Finance Bill, 2010). All the amendments proposed by the treasury benches in the Finance Bill were passed while Opposition members opposed various amendments moved by Abdul Hafeez Sheikh, however the Lower House rejected all those amendments which were moved by Opposition members.
On the passage of the budget, Prime Minister Yousuf Raza Gilani in his speech congratulated the treasury as well as opposition benches for the approval of budget and admired the House for a historic quality discussion on the budget. He was of the view that the budget was prepared while focusing on reality and transparency. “We will fulfil all promises of this budget,” Premier Gilani added. He also announced honorarium salary of one month for the employees of different departments who remained on duty during the budget session.
The Federal Budget 2010-11 provides Rs 663 billion for Public Sector Development programme while a tax collection target of 1,667 billion rupees has been fixed for the next financial year. However the estimated budget deficit for the fiscal year is about 700 billion rupees. In the budget, the Government has also taken measures to improve the lives of government employees by giving them a raise of 50 percent to their basic pay, besides providing relief to the pensioners retired after 2001. The finance act also allocated Rs 50 billion for BISP to help deserving people of the country. It also approved reduction in Customs Duty on 29 goods, 1 percent increase in General Sales Tax that do not include food items and imposition of Capital Gains Tax on the sale of shares in stock market.
Prior to the passage of Finance Bill 2010, Leader of the Opposition Ch Nisar Ali Khan said that the Opposition had given effective suggestions, which were ignored by the Government. “Last budget was approved unanimously and this budget can also be passed unanimously but the Government did not develop consensus while preparing the budget. Almost 61 suggestions of Senate were accepted but the Government ignored the proposals of 140 members of the National Assembly,” Leader of the Opposition said. However he congratulated the Prime Minister, the Minister for Finance and other members for the open debate on budget.
Terming it a one-sided budget, Nisar said that his party would not vote for the budget. He regretted that PML-Q did not support his party in opposing the amendments. Later PML-N staged a walkout from the House.
Central leader of PML-Q Riaz Hussain Pirzada, however, said that PML-Q had taken the decision to support the budget in the best interest of democracy. He also congratulated the Prime Minister, the Minister for Finance and other members. Minister for Law and Parliamentary Affairs Babar Awan said that 161 members participated in the debate on budgetary proposals for 12 days, consuming 39 hours and 37 minutes.
Finance Minister Abdul Hafeez Sheikh also presented the schedule of authorised expenditure 2010-11 and supplementary schedule of authorised expenditure 2009-10 before the National Assembly.

Backdoor diplomacy on to resolve issues with India: PM


ON BOARD PM’s AIRCRAFT (APP) – Prime Minister Syed Yousuf Raza Gilani Monday has said that the present government has full support of all the political parties and is committed to resolve the problems of people.
Talking to newsmen on board his special aircraft before reaching Kathmandu on his way to Bhutan to attend the 16th SAARC Summit, he said for the first time in its history, the PPP government enjoyed the support of the establishment that was clear from the progress of the government in war against terror and at the international level. He said, “For the first time, we are on the same page and moving in one direction.”
He said all the leadership in the country is unanimous on all issues and determined to resolve them jointly to provide relief to the public.
Prime Minister said for the first time the present PPP government was pro-establishment.
He said PPP came into power in 2008 after its leadership that remained in exile returned and gave sacrifices with the commitment to solve problems of the people.
He said: “I am certain that the international community would extend full help and cooperation to Pakistan keeping in view commitment of the government in the war against terror.”
Gilani said a high-level committee had been constituted by him to probe the hosing down of the assassination site of Shaheed Benazir Bhutto.
He said the committee was all-powerful and would determine the causes of removal of evidence from the crime scene and then the government would take appropriate action in the light of its recommendations.
Replying to a question regarding talks with India, Prime Minister said efforts were being made through normal diplomatic and backdoor channels to resolve all the issues.
Answering a question about demand for civil nuclear technology from the United States, Gilani said during his recent visit to the US, he raised the issue at the nuclear summit as it was PakistanÂ’s genuine need and requirement due to gap in supply and demand of electricity.
Regarding the 18th Amendment, Prime Minister said a committee was being constituted to implement the amendment in letter and spirit.
He said all the provinces and stakeholders were being taken on board and he was consulting the political leaders. He said he had already discussed the issue with Nawaz Sharif.
“The elements who were making efforts to turn the public opinion against the present government have failed after the passage of 18th Amendment from both houses of the Parliament,” he added.
Gilani said after resolving the basic issue of constitution, now the government was focusing its attention on tackling issues like unemployment, loadshedding and provision of essential needs of life.
Regarding power shortage, Prime Minister said a number of projects including Rental Power Projects were under way to increase electricity generation.
Meanwhile, on his arrival at Kathmandu Airport, Prime Minister was accorded a warm welcome by Deputy Prime Minister of Nepal Vijay Kumar Gachadar and other officials.
On the other hand, Pakistan and Nepal have agreed to enhance bilateral relations and decided to further promote trade, economic, people-to-people, defence and cultural relations.
These views were expressed during the meeting between Premier Gilani and his Nepalese counterpart Madev Kumar Nepal at the Prime Minister House. It was the second meeting between the two premiers, as previously they met in Sharm-el-Sheikh in July last.
Gilani emphasised the need to translate the cordial relations into strong bonds of friendship between the two countries.
Gilani said, “We need to focus on the promotion of bilateral cooperation in the areas identified in the roadmap to ensure our continued partnership in achieving peace and security in our region and at the international level.”
The prime minister informed Madev Kumar that Pakistan had finalised projects worth Rs 13.17 million for development in different sectors of Nepal under Special Assistance Programme for South Asia (SAPSA) in fiscal year 2009-10.
Referring to bilateral trade, Gilani said, “We need to find ways and means to strengthen our economic and commercial ties.”
Besides highlighting the importance for Free Trade Agreement between the two countries, he emphasised the need to expedite the process proposal for initiating negotiations on bilateral investment treaty, which is presently under consideration of Nepalese government.
He said efforts should be made to finalise Preferential Trade Agreement between the two countries to increase trade volume.
He said the Joint Economic Commission set up in 1983, had so far met only for five times and its last meeting was held in March 2005. “We should reactivate this forum for identifying the new areas of possible cooperation and monitoring the progress in our trade and commercial ties.”
The prime minister stressed the need for early decision to conclude a Bilateral Extradition Treaty, which is pending with the Nepalese government since 2006.
Regarding defence cooperation, Premier Gilani offered more assistance to Nepal, saying Pakistan would continue accommodating officers of Nepalese armed forces in its defence and defence production training institutions.
The prime minister offered to provide small arms and ammunition, as Nepal has already purchased small arms worth 2.23 million dollars in 2007.
Nepalese Prime Minister Madev Kumar appreciated the reconciliatory approach of Gilani and said Nepal was also going though constitutional reforms, and would get benefit from his the experience in this regard.
He pointed to the ongoing cooperation in banking sector and stressed the need of similar support setting up cement factories, construction sector, infrastructure, tourism and agriculture sector.
Both the leaders also discussed their contribution in the United Nations Peace, keeping in view the fact that the two countries are the largest contributors.
Prime Minister Gilani invited Kumar to visit Pakistan, which he accepted.
During his stay, he also called on Nepalese President Ram Barn Yadev at the President House. During the meeting, Prime Minister Gilani offered condolences on the sad demise of former Nepalese premier GP Koirala. President Yadev belongs to late KoiralaÂ’s Nepali Congress.
Giving details of his meeting with his Nepalese counterpart, Gilani said, despite its economic constraints, Pakistan would continue supporting the development of socio-economic sectors of Nepal through technical cooperation.
He said both the countries could work together under Saarc to promote regional cooperation.
President Yadev appreciated the role of Pakistan in the war against terror and in ensuring peace and security in the region.
While extending invitation to Premier Gilani for an official visit, he said, the present short visit was not sufficient to exchange views and express the true relationship.

No dictation needed on N-plan: Gilani


WASHINGTON – Prime Minister Syed Yousuf Raza Gilani has said that invitation to first Nuclear Security Summit is a practical proof of a ‘great legitimacy of Pakistan’s nuclear programme’ as the US President Barack Hussain Obama has unequivocally expressed confidence in its security and safety.
Addressing a concluding press conference after the end of the Summit, the PM while answering the question what Pakistan gained out of it said, “Invitation and participation, in the first place, in this Summit itself is a great legitimacy for Pakistan’s nuclear programme.”
He was of the view that not only the visit remained successful in the bilateral context but also Pakistan gained its objective of legitimate recognition as responsible nuclear state. When asked about formal recognition as legitimate nuclear state, he said, “It needs patience.”
During a number of informal interactions with President Obama during the conference, the Prime Minister said that ‘we have convinced him about nuclear security action plan.”
Explaining about the issue of fuel recycling, the Prime Minister aided by PakistanÂ’s chief negotiator Masood Khan said that last meeting of the National Command Authority had proposed a fuel bank including those countries that have capacity to recycle fuel.
Regarding handshake and informal interaction with the Indian Prime Minister, Premier Gilani said, “He was aware of Pakistan’s role that was extremely important. And entire world is considering Pakistan’s position working for the global peace. Therefore, friends of Pakistan are trying to normalise relations between India and Pakistan so that Islamabad should focus totally on terrorism.”
“There was not even a single negative thing during my informal meeting with Indian Prime Minister that was in cordial atmosphere and he appeared with an open mind,” Gilani said answering another question. Still he was unable to say anything about a ‘purposeful or formal meeting with his Indian counterpart at the forthcoming SAARC Summit.”
The Prime Minister told the journalists that he twice held very exclusive meetings with Chinese President Hu Jintao and there was no mention of sanctions against Iran or anything of the sort.
Answering questions about the timeframe of strategic cooperation with US beyond security the Prime Minister said, “Our top priority is electricity, and the US has already committed to help us upgrade our existing structure.” The US, he added, has also ensured Pakistan to support for market access during the next Pakistan-European Union Summit in Brussels. President Obama has also promised to expedite ROZS.

Pakistan would take decision on country’s nuclear programme itself, Gilani said and added “We do not need dictation from anyone on our nuclear programme.”
On the other hand, Gilani separately met US Secretary of State Hillary Clinton, Chairman US Foreign Affairs Committee Senator John Kerry and a delegation of International Monetary Fund (IMF).
During the meeting with Hillary Clinton, issues relating to Pak-US Strategic Dialogue, energy crisis in Pakistan, war against terrorism and regional situation were discussed.
Hillary assured her countryÂ’s assistance to overcome energy needs of Pakistan.

All dictatorial amends to go


LAHORE – Prime Minister Yousuf Raza Gilani on Sunday said the nation would be getting another good news in March this year when all undesirable amendments introduced in the Constitution by the dictators would be revoked.
Addressing a joint meeting of PPP Punjab Executive Committee, divisional coordinators and district presidents at State Guest House here, the PM said that Constitutional Reforms Committee had almost completed its work and the Constitution would be restored to its original form before next presidential address to joint sitting of the Parliament in March this year.
Gilani said all unconstitutional changes made in the Constitution during dictatorial rules, including 17th Amendment, would be repealed by striking a balance of power between the offices of the prime minister and the president.
It is to be noted that PM Gilani recently gave a good news to the nation by withdrawing notifications regarding appointment of judges which was issued by the government against the advice of Chief Justice of Pakistan Iftikhar Muhammad Chaudhry, and which had brought the judiciary and the executive face to face.
Gilani told partymen that a strong party organisation was essential for a strong government, as the latter drew its strength from party cadres. He said the PPP leadership was determined to strengthen the party at gross roots level. He asked them to get ready for the upcoming local body elections in Punjab by starting the essential homework at the early stage.
The PM said the government was facing tough challenges in the form of terrorism, price-hike, unemployment and lawlessness, but it had the capability to face these. He asked the partymen to float their suggestions to overcome these problems.
Gilani also announced some development projects government intended to undertake in the near future. He said a teaching hospital would be set up in Bahawalnagar, whereas engineering universities would be established at Gujranwala and Sargodha besides an engineering college at Attock. He said a five-kilometre long overhead bridge would be constructed connecting old Ravi Bridge with Lahore City Railway Station.
Earlier, office-bearers of different party organisations complained to the PM about workersÂ’ problems, which they said, were not being addressed, neither at the provincial nor at federal level. Upon this, the PM told them that he was meeting with PML-N Quaid Nawaz Sharif and Punjab CM on Monday (today) at Raiwind over breakfast and would take up coalition matters with them.
It has been learnt that PM Gilani would brief PML-N leaders about the progress so far made on constitutional reforms and reassure them that all unconstitutional amendments would be struck down before President Asif ZardariÂ’s address to joint sitting of the Parliament. He is also likely to take up some contentious issues with Sharifs like renaming of NWFP in todayÂ’s meeting.
It merits mentioning here that Prime Minister Gilani has met Shahbaz Sharif several times and had also occasionally talked to Nawaz Sharif in the last two years to improve working relationship between the PPP and PML-N in Punjab, but with little success. The complaints of PPPÂ’s provincial parliamentary party and ministers regarding implementation of 40:60 power sharing formula as agreed between the two parties in the beginning are still there, as the PML-N has not moved an inch to share power with its coalition partner in Punjab. In this context, MondayÂ’s meeting between Premier Gilani and PML-N leaders is less likely to come up with any tangible outcome on the issues in question.

Restored judges don’t need Parliament’s approval: PM


ISLAMABAD – Prime Minister Syed Yousuf Raza Gilani was quick in eating his words on Tuesday on judges’ ratification issue and said that in his Monday’s speech, he did not mean to say that the judges, who were restored through his executive order, required ratification from the Parliament.
He, once again, made it loud and clear that whatever would be the interpretation of the apex court on the judgesÂ’ appointment issue the Government would accept it and implement it in its true letter and spirit.
Speaking on the floor of the National Assembly on Tuesday afternoon, Premier Gilani said that in his MondayÂ’s address in the Parliament, he did not mean to say that the judges who were restored through his executive order, needed to be approved by the Parliament. However, he said that he tried to say that at the time of restoration of judges, this issue had arose and some legal minds were of the view that in case of restoration of the judges through an executive order, they would be requiring ratification of the Parliament.
He recalled that the decision of restoration of the judges was made at around 12.00 mid-night on March 16, 2009 but he made the decision public at around 6.00 in the morning only because he was having the input of the legal minds in the draft of the executive order for restoration of the judges to avoid legal complexities.
He further said that there was also a proposal that the judges should be restored through passage of a resolution from the Parliament but in his view the executive order was the better option for it and he did it in consultation with the legal experts.
He, once again, said, “ The Parliament is the supreme body and it has the right to write and rewrite the Constitution,” and quickly added that the Government would accept the decision of the apex court.
He further said, “Under the Constitution, President of Pakistan is the authority to appoint judges with consultations of Chief Justice of Pakistan.” But the consultation should be meaningful, he said. He added that in this connection the Government had requested the court to further interpret the procedure for appointment of the judges.
He further said if the Parliament, which is the supreme body, wants that a judge should appoint a judge, then they are ready to do it as well.
He said that the Constitutional Reforms Committee of the Parliament was in session and in case they came up with some other mechanism for the appointment of judges then the Parliament had every right to do legislation in this regard.
He, however, made it clear that whatever amendments the Committee would propose, the current vacancies in the apex judiciary would be filled through the existing mechanism.
Earlier, the National Assembly on Tuesday referred four bills, introduced by private members, to the standing committees concerned of the House for further discussions. These bills include Rehabilitation Authority for Victims of Violence and Abuse Bill moved by Mrs. Yasmeen Rehman and Dr. Azra Fazal Pechuhu and Pakistan Citizenship (Amendment) Bill moved by Ms. Bushra Gohar. Dr. Azara Fazal Pechuhu and others moved the HIV/AIDS Safety and Control and Raja Muhammad Asad Khan and others moved the Code of Criminal Procedure (Amendment) Bill before the House.
Minister for Labour and Manpower, Syed Khurshid Shah has said that the Government held the judiciary in high esteem and was bound to implement its verdicts on all issues. Responding a point of order in the National Assembly raised by Ms. Anusha Rehman, he said the PPP was among those, which made efforts for restoration of the judges. Referring to speech of the Prime Minister in the House yesterday, he said that he (PM) had no intention to disgrace the judiciary but he talked about the difficult position, which the Government was facing for their restoration. Later, the House resumed discussion on an adjournment motion regarding construction of Baghliar and Kishan Ganga Dams and Wuller Barrage by India in violation of Indus Basin Water Treaty.
The members of the National Assembly, taking part in the debate on aforesaid issue, urged the Government to take up water issue with India on the international level.
They said that India was violating Indus Basin Water Treaty and was working on a plan to construct dams to utilise Pakistani water that must be stopped. They condemned India for construction of Baghliar Dam and its plans for construction of Kishan Ganga Dam and Wuller Barrage. The members said that Pakistan was facing acute shortage of water and according to the United NationsÂ’ report that per capita water availability has come down from 5500 cubic metres in 1950 to 1000 cubic metres at present. They said that Pakistan was being converted into a desert and the Government should take the notice of the situation and should make efforts to compel India for implementing Indus Basin Water Treaty.

Federal Minister for Labour and Chief Whip, Khurshid Shah in response to a point of order gave assurance to the House that women travellersÂ’ respect and honour at security check post in FATA and settled areas would be ensured.
“Checking is a routine process but we shall ensure respect of the women,” he said. However, he mentioned that in some cases terrorists wear veils to carry out terrorist activities. The Minister proposed to have scanners or deployment of lady security personnel for checking of the women.
Kamran Khan, on a point of order, said in settled areas adjacent to Waziristan, the women were humiliated during checking at police and FC check posts. “These personnel should be ordered to maintain respect of the women and alternate security arrangements should also be ensured,” he added.
On another point of order, Bushra Gohar pointed out serious irregularities mentioned in the audit report of a USAID funded project executed in FATA during 2008. The member demanded that the audit report in the House should be presented, as she claimed that money allocated for the FATA under certain other projects was not properly spent in the area.
Mahboobullah Khan urged the Government to continue projects of National Commission for Human Development (NCHD) and recounted number of projects successfully executed under this programme. “The NCHD has got enrolled 8.2 million children between 5-7 years age, at schools in 117 districts, technically trained 13.77 million women in 80 districts, trained 669,000 women for vaccination, trained 327,000 volunteers and trained thousands of the Government employees,” he said.
Gul Muhammad Jakhrani demanded to close down the power plant being installed on the Chashma Canal.
Khalida Mansoor demanded of the Government to brief the House about recent population control agreement with UNFPA. Nadeem Afzal Gondal demanded ban on the dowry, saying that millions of poor people in the country could not get their daughters married due to this curse.

President returns summary


ISLAMABAD – On the recommendation of Prime Minister Syed Yousuf Raza Gilani President Asif Ali Zardari has returned the summary sent by Chief Justice for elevation of Lahore High Court judge Justice Saqib Nisar to Supreme Court with the request to reconsider his earlier recommendation so that the most senior judge in the Lahore High Court be elevated to the apex court.
According to a handout of Ministry of Law, Justice & Parliamentary Affairs, PM Gilani, keeping in view the lego-constitutional position has advised President Zardari to request the Chief Justice to reconsider his recommendations dated Dec 19, 2009 regarding the elevation of LHC judge Justice Mian Saqib Nisar as judge Supreme Court of Pakistan. Acting on the advice of Premier Gilani, President Asif Zardari has returned the Chief JusticeÂ’s summary with the request to reconsider it and make recommendation afresh so that the most senior judge of Lahore High Court be elevated to the Supreme Court of Pakistan.
The recommendation of the Chief Justice to appoint Justice Mian Saqib Nisar, Senior Judge of the Lahore High Court as Judge of the Supreme Court was duly considered by the Prime Minister and the President. The Prime Minister of Pakistan keeping in view the legal position and the guidelines given in the Al-Jehad Trust Case PLD-1996 by the Supreme Court of Pakistan that primacy in the matter of elevation of High Court judges to the Supreme Court has to be given on the basis of seniority, the statement further stated.
“The most senior judge in the High Court has to be elevated to the Supreme Court, unless found to be unsuitable by the Chief Justice for such elevation,” it was further stated. Justice Khwaja Muhammad Sharif, Chief Justice of Lahore High Court, is the most senior judge and therefore, it is his right to be elevated to the Supreme Court.

PM orders swift execution of SC verdict on NRO


ISLAMABAD – Prime Minister Syed Yousuf Raza Gilani on Friday discussed the detailed judgement of Supreme Court on NRO with the Attorney General and the Federal Secretary for Law and Justice.
The Prime Minister also discussed various options including filing of review petition and transparent implementation of the verdict.
According to the PMÂ’s House Spokesman, the Attorney General and the Federal Secretary briefed the Premier Gilani on various aspects of detailed judgement on NRO.
Soon after having a briefing from legal experts on detailed judgement on NRO case, the Prime Minister Syed Yousuf Raza Gilani had a one-on-one meeting with President Asif Ali Zardari.
Both the leaders, the sources informed, had discussed various implications of detailed judgement of NRO case and various options with Government to deal with it remaining within the precincts of law and Constitution.
About the briefing from legal experts, the spokesman of PMÂ’s House further informed that the meeting also discussed transparent implementation of the Supreme Court verdict on NRO. The sources informed that Premier Gilani was briefed about the consequences of Supreme Court verdict on NRO in length while the meeting also mulled different options to devise future strategy in this respect.
During the meeting, sources added, the Premier was of the view that Government would not take any decision in haste with regard to apex court verdict on NRO and strategy to ensure implementation on its verdict would be devised in accordance with law and constitution.
The Premier was also apprised of the review appeal against SC verdict and implementation on it.
Staff Reporter from Lahore adds: Prime Minister Syed Yousuf Raza Gilani has said he has issued directives to the relevant authorities to implement the Supreme Court decision on NRO in letter and spirit.
Talking to media men after attending a sports function here on Friday, Gilani said his government had great respect for all the institutions of the State and it would always abide by the decisions of the Supreme Court.
He said he had issued directive for complete implementation of the Supreme Court verdict on NRO.
He further maintained that the President Asif Ali Zardari faced no threat to his office as he enjoyed Constitutional immunity (in the NRO cases) under Article 248 and support of the Parliament as well.
On a question, Gilani said that the government was elected with the public vote and had not come to power through back door,therefore, there was no threat to it nor to the democratic system.
Talking about the reconciliation policy in this testing time for the nation, the PM said that he would take along every political party and strive to get united to meet the challenges facing the country.
To a question, he replied that any amendment in the Constitution would be brought through the Parliament.
Replying to another question about the elevation of Lahore High Court judge to the Supreme Court to fill in the vacancy there, Gilani said, they had always acted upon the directions of the Supreme Court and on the question of two judges law and the Constitution would also be followed.
Replying to a question, he said Ch Aitzaz Ahsan was the party leader and had a status in the PPP and the party consulted with him from time to time.
He said the President would soon see him to take his advice.
To a question, the Prime Minister said that PML-N leadership had good relations with Aiwan-e-Sadar and Punjab Chief Minister Mian Shahbaz Sharif had expressed similar sentiments on Friday.
Regarding his meeting with Chaudhry Shujaat Hussain, he said such meetings with leaders of different political parties was a routine matter.
He said he had long been listening that circumstances were not good. However,Â’we have turned the challenges into opportunities for betterment of the country and there is no need to worryÂ’.
